Service Specific Terms & Conditions - Maxis Postpaid Share 39 ("SSTC")

- Plan: Maxis Postpaid Share 39.
- You: Person(s) signing up for the Plan.
- Selected Regions refer to the following states:
- East Coast: Kelantan, Pahang and Terengganu; and
- East Malaysia: Sabah, Sarawak and WP Labuan.
- Your use of the Plan and Service(s) is subject to the General Terms & Conditions at https://www.maxis.com.my/en/terms-conditions/general/maxis-consumer/ (“GTC”), this Service Specific Terms & Conditions – Maxis Postpaid Share 39 (“SSTC”), Maxis Fair Usage Policy at https://www.maxis.com.my/en/terms-conditions/general/maxis-fair-usage-policy/ (“Maxis FUP”) and any other applicable terms and conditions available, all at www.maxis.com.my/terms-conditions/personal/.
- Capitalised terms herein have the same meaning as defined in the GTC.
- Any conflict or inconsistency between this SSTC, the GTC and Summary Terms and Conditions (“STC”), shall be construed in the following order of precedence: (a) SSTC; (b) GTC; and (c) STC.
- We reserve the rights without liability, to revise this SSTC, Plan and our pricing. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information on the Plan and Service(s) at www.maxis.com.my/tnc), including changes to the Agreement. Your continued use of the Service(s) and/or Plan (after the Effective Date of any revision/change to the terms and conditions of Service(s) and/or Plan) shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same. If you do not accept such revisions/changes, you will terminate the Plan and/or the use of the Service(s) by giving us notice within fifteen (15) working days from the Effective Date, failing which you are assumed to have accepted the changes.

- Subscriptions for this Plan must be made and submitted:
- by walking into any Maxis Centres, Maxis Exclusive Partners stores and/or Maxis’ authorized dealers in the Selected Regions; or
- via our telesales campaigns or promotions.
- You must be an individual who resides in the Selected Regions with a valid billing address in the Selected Regions. We will require you to provide evidence such as NRIC, passport or utilities billing address for validation purposes.
- Further, You must be the principal account holder of any of the following plans to be eligible to subscribe to this Plan:
- Maxis Postpaid 98, 108, 128, 158, 188, 248 or 368, which applicable terms and conditions are at https://www.maxis.com.my/en/terms-conditions/products-services/mobile/postpaid;
- Maxis Postpaid 68, which applicable terms and conditions are at https://www.maxis.com.my/en/terms-conditions/products-services/mobile/postpaid-68/;
- Maxis Postpaid 79, 109, 139, 169 or 199, which applicable terms and conditions are at https://www.maxis.com.my/en/terms-conditions/products-services/mobile/postpaid-plan; or
- Maxis Postpaid 69 or 99, which applicable terms and conditions are at https://www.maxis.com.my/en/terms-conditions/products-services/mobile/postpaid-69-and-99/.
- You are ineligible to subscribe to the Plan if you owe us any payments.
- This Plan is inapplicable to you if you are a commercial user and/or bulk subscriber.
- Notwithstanding the above, we reserve the right to alter the eligibility criteria at any time.
- Subscriptions for this Plan must be made and submitted:

- The Plan’s structure is set out in the attached Appendix and also published on our website at https://www.maxis.com.my/en/mobile-plans/maxis-postpaid-69-and-99/, as may be updated by us from time to time. Charges published are exclusive of all applicable taxes.

- A deposit of RM150 is chargeable to non-Malaysian principal account holder of any of the plans set out in Clause 10 above when signing up for this Plan.
- Non-payment of your Bill may result in suspension or barring of all the Services under the Plan until the outstanding amount is paid.

- You agree and accept that the unlimited Minutes Allocation for Voice and unlimited SMS' Allocation applicable to the Plan only applies to the following:
- domestic mobile ON-net usage (Maxis to Maxis calls and SMS’) for Maxis Postpaid lite & start (excluding OFF-net usage (calls and SMS’ from Maxis to other mobile service provider), calls to fixed lines, video calls, calls to numbers with special charges e.g. 1-300/1-700/600 & 121, TM100, 1MOCC and 080-prefix numbers for border calls to Brunei).
- domestic mobile/fixed ON-net & OFF-net usage for the Plan (excluding, video calls, calls to numbers with special charges e.g. 1-300/1-700/600, 121, TM100, 1MOCC & 080-prefix numbers for border calls to Brunei).
- standard person-to-person calls or texts and not for any commercial and/ or non-personal usage;
- non multiple simultaneous calling, conference calling (unless you are subscribed to the conference calling service with Maxis), re-supply, call centre usage, telemarketing, bulk messaging, application-to-person communication, continuously call forwarding, auto-dialing, machine-to-machine communication (including by using your SIM card in any other devices), Cellular Trunking Units (CTUs), or any other activity we consider to be non-standard usage.
- Please refer to Appendix attached to this SSTC for applicable Charges on calls and SMS made outside of the scenarios in Clause 17 above.
- You agree and accept that the unlimited Minutes Allocation for Voice and unlimited SMS' Allocation applicable to the Plan only applies to the following:

- For mobile internet package allocated with the Plan, you agree and accept:
- You will experience mobile internet browsing at reduced speeds and with no EXCESS charges if any usage exceeds the allocated mobile internet;
- The mobile internet package allocated within the Plan is exclusively for domestic usage only;
- You may purchase one-time passes to add more data (non-recurring) BEFORE you exceed your mobile internet package allocation. Such upgrade is available through your UMB, Maxis app, Maxis Online Account or WAP menu and accessible through your Mobile Phone, other available Devices or channels as we may inform you from time to time.
- You can opt for upgrades or downgrades of the Plan at any Maxis stores or by calling our contact centres (123); and
- If you upgrade or downgrade your existing plan to the Plan, the monthly fees of your existing plan and the new Plan will be pro-rated against your billing cycle date. However, you will start enjoying the Mobile Internet Package allocation of your Plan upon effective upgrade or downgrade. You will be charged the full monthly fee applicable to the Plan the following billing cycle.
- For mobile internet package allocated with the Plan, you agree and accept:

- The rates outlined in the Plan structure do not account for usages while on an overseas roaming network. Whilst roaming overseas, the prevailing data roaming charges at https://www.maxis.com.my/lifestyle/roaming-idd/international-roaming/ shall apply.

- You must:
- ensure you have a 5G capable, supported and enabled Mobile Device to access/ utilize the 5G network. A 5G software update from the device manufacturer may be required which will not be the responsibility of Maxis;
- located within the 5G network coverage area. A map of 5G network coverage area can be found at https://www.maxis.com.my/en/about-maxis/5g-network/#5g-map; and
- have a 4G LTE enabled SIM. You may check your SIM status by dialing this code *100*8*5# from your phone.
- The 5G service(s) is only available within the 5G network area via use of a 5G capable, supported and enabled Mobile Device. When you are located outside the 5G network coverage area, you’ll automatically switch to any of our other available networks.
- You must:

- Maxis does not represent, warrant, undertake and/or guarantee that the 5G service(s) will be:
- provided without errors;
- uninterrupted; and/or
- that your experience of the existing Services which you are subscribing from Maxis on our other available networks will not be impacted in an adverse manner,
- Without derogating from the disclaimers and limitation of liability under the GTC which are applicable to you, Maxis makes no representation or give any condition, indemnity, warranty, guarantee, whether express or implied, about whether the services offered pursuant to the 5G service(s) will operate and be compatible with any Content, Equipment, hardware or software or that it will be compatible with the national 5G wholesale network. You acknowledge and agree that Maxis relies on one or more third party service providers in relation to the 5G service(s) (including its availability and continuity) and as such, to the fullest extent permitted by law, Maxis excludes any liability and shall not be liable to you and/or any third parties whether in contract, tort or otherwise for any loss, damage or liability incurred or sustained by you and/or any third party (including loss of revenue or loss of services or connectivity) caused by or in relation to any delay, failure, breakdown, inability to use or access, interruption or disruption by any of our third party service providers including Maxis’ third party service provider of the national 5G wholesale network or in respect of interruption or adverse impact to existing services subscribed from Maxis arising from your purchase of the 5G service(s).
- Notwithstanding anything to the contrary in this SSTC, you acknowledge and agree that:
- you have not relied on any representation, warranty, statement or similar made by Maxis’ third party service provider of the national 5G wholesale network in connection with your decision to use or the manner in which you will make use of the 5G service(s) including where such 5G service(s) is provided to you as part of products or services (or bundled products or services) by Maxis;
- you are solely responsible for your decision to use, and the manner in which you will make use of, the 5G service(s) and does so at your own risk (including where the 5G service(s) is used in connection with the preservation of life or property);
- you are solely responsible for making your own decisions on appropriate alternative redundancy, connectivity and data solutions in the event the 5G service(s) is unavailable, disrupted or operate with error;
- the 5G service(s) will not necessarily operate without error and will not always be available;
- Maxis’ third party service provider of the national 5G wholesale network does not owe you any duty of care or similar duty and you release Maxis’ third party service provider of the national 5G wholesale network from any liability arising from your use of the 5G service(s); and
- you must not do anything that may interfere with Maxis’ third party service provider of the national 5G wholesale network and/or connect or knowingly permit any third party to connect any equipment to the 5G network.
- Maxis does not represent, warrant, undertake and/or guarantee that the 5G service(s) will be:

- We reserve the rights at any time at our sole discretion whether with or without notice to you and without being liable to you and/or any third party, to immediately interrupt, bar, suspend or restrict the Plan (including 5G service(s)) for such time as we see fit, withdraw or terminate, discontinue or disconnect the services including if:
- any technical failure occurs in services pursuant to the Network (which includes any network operated by any third party which are connected to Maxis’ network)
- the services pursuant to the 5G services(s), our Network or systems are being upgraded, modified or maintained;
- your usage shows excessive usage or placing unusual burdens on our Network;
- in our determination, your usage of mobile data, voice and SMS’ is used or originating from outside of the Selected Region that you have registered with us for more than three (3) consecutive months;
- in our determination, the Plan is or may be used by you for unlawful activities or for suspected fraudulent activities;
- your usage is not in accordance with the Maxis FUP or contrary to any of the terms and conditions of this SSTC and/or the GTC;
- is for commercial/non-personal purposes;
- where matters beyond our reasonable control prevents us from performing and/ or continuing our obligations this SSTC, the GTC and/or the Maxis FUP;
- you have relocated or have been relocated to an area outside the 5G network coverage area; and/or
- we are required to do so by law, statute, enactment, regulations, code or by any relevant authorities, including the Maxis’ third-party service provider of the national 5G wholesale network,
- If you change your current rate plan to the Plan, you will not be able to carry forward any promotions/benefits that you are currently enjoying under your existing rate plan to your new Plan.
- In connection to any Plan survey, comments, suggestions and/or feedback submitted by you to Maxis, you agree that Maxis may use all comments, suggestions and feedback collected in any manner without restriction or obligation for any purpose, including but not limited to incorporation or implementation of such comments, suggestions and feedback into Maxis’ product or service, to develop, improve and/or evaluate the Plan. Except for personal data, no comments, suggestions and/or feedback will be deemed as your confidential information.
- We reserve the rights at any time at our sole discretion whether with or without notice to you and without being liable to you and/or any third party, to immediately interrupt, bar, suspend or restrict the Plan (including 5G service(s)) for such time as we see fit, withdraw or terminate, discontinue or disconnect the services including if:

- Subject to our GTC, a principal line holder may at any time terminate the Plan as follows:
- by calling our customer care line at 1-800-82-1123 or dial 123 from your mobile;
- by walking into our Maxis Centres listed on www.maxis.com.my; or
- by writing in to customercare@maxis.com.my.
- Upon termination of your relevant principal Maxis Postpaid plan as set out in Clause 10 above, this Plan will be automatically terminated and all benefits under this Plan will automatically cease on the termination date.
- The terms and conditions stated herein shall be governed by the laws of Malaysia and subject to the exclusive jurisdiction of the courts of Malaysia.
- Subject to our GTC, a principal line holder may at any time terminate the Plan as follows:
