Service Specific Terms & Conditions – Free 24 Months Samsung Care+ (S24 Series Pre-Order) (“SSTC”)

General
- The Campaign: Free 24 Months Samsung Care+ for S24 Series Pre-Order.
- You: Person(s) who signed up for any of Maxis’ Plans (as described below) with any Mobile Device(s) during the Pre-Order Campaign Period and successfully collected the Mobile Device(s).
- Maxis’ Plan(s) refers to:
- Maxis Device Contract; and/or
- Maxis Zerolution.
- Mobile Device(s): Any of the Samsung Galaxy S24 Series mobile devices (i.e., Samsung Galaxy S24, Samsung Galaxy S24+ and/or Samsung Galaxy S24 Ultra).
- Pre-Order Campaign Period: from 18 January 2024 until 6 February 2024 (both dates inclusive).
- Offer: Free 24-months Samsung Care+ which comprises the following:
- two (2) years coverage for accidental & liquid damage and one (1) year extended warranty, which is an insurance product underwritten by Tune Insurance Malaysia Berhad (“Tune”). For more details, please refer to https://www.samsung.com/my/offer/samsung-care-plus/ and Certificate of Insurance issued to you by Tune upon activation of the Offer; and
- two (2) years Samsung Care+ Device Support Package (Value-Added Service) which terms and conditions is at https://images.samsung.com/is/content/samsung/assets/my/offer/samsung-care-plus/Samsung-Care-Plus-Device-Support-Package-Term-of-Service.pdf.
- The Campaign and use of the Service(s) is subject to the General Terms & Conditions (“GTC”) at https://www.maxis.com.my/en/terms-conditions/personal/general/maxis-consumer/, this Service Specific Terms & Conditions – Free 24 Months Samsung Care+ (S24 Series Pre-Order) (“SSTC”), Summary Terms and Conditions (“STC”) at https://www.maxis.com.my/en/terms-conditions/general/summary/, Maxis Fair Usage Policy (“FUP”) at www.maxis.com.my/FUP and any other applicable terms and conditions, all available and www.maxis.com.my/terms-conditions/personal/.
- Capitalised terms herein have the same meaning as defined in the GTC.
- Any conflict or inconsistency between this SSTC, the GTC and STC, shall be construed in the following order of precedence: (a) SSTC; (b) GTC; and (c) STC. Further, this Campaign is subject to the respective SSTC listed under Clause 17 below and the terms and conditions therein shall be applicable to this Campaign. For clarity, any conflict or inconsistency between this SSTC and the respective SSTC listed under Clause 17 below, this SSTC shall take precedence.
- We reserve the rights without liability to revise this SSTC, the GTC, Campaign and our pricing. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information on the plan(s) and Service(s) at www.maxis.com.my/terms-conditions/, including changes to the Agreement. Your continued use of the Service(s), and/or plan(s) (after the Effective Date of any revision/change to the terms and conditions of the Agreement, Services, and/or plan(s)) shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same. If you do not accept such revisions/changes, you will terminate the Plan(s) and/or the use of the Services by giving us notice within twenty-eight (28) days from the Effective Date failing which you are assumed to have accepted the changes.
Eligibility
- You must be a new or existing customer of Maxis who:
- is at least 18 years of age;
- signs up to pre-order any Mobile Device(s) with any Maxis Plan(s) during the Pre-Order Campaign Period;
- successfully registers the Mobile Device(s) which you pre-ordered with Maxis with any Maxis Plan(s); and
- collect the Mobile Device(s) which you pre-ordered with Maxis at one of our Maxis stores or receive the Mobile Device(s) via delivery (if you have ordered online).
- You accept and agree to be bound by the terms and conditions of the relevant Maxis Plan(s) you sign up with Maxis. In this regard:-
- If you sign up for Maxis Device Contract, you accept and agree to its terms and conditions at https://www.maxis.com.my/en/terms-conditions/personal/devices/contract/device-contract/;or
- If you sign up for Maxis Zerolution, you accept and agree to its terms and conditions at https://www.maxis.com.my/en/terms-conditions/devices/contract/zerolution/.
- You are ineligible to participate in this Campaign if you have any outstanding payments with us.
- This Campaign is inapplicable to you if you are a commercial user and/or bulk subscriber.
- Notwithstanding the above, Maxis reserves the right, at its sole discretion, to determine if you are suitable and/or eligible to participate in the Campaign.
Charges
- You are responsible for payment of all Charges associated with Maxis Plan(s). Charges exclude applicable taxes.
Offer – Samsung Care+
- Samsung Care+ is provided and underwritten by Tune under group policy issued to Samsung Malaysia Electronics (SME) Sdn Bhd (“Samsung”), assisted by Bolttech Device Protection Malaysia Sdn Bhd, who is an agent of Tune.
- The Offer is embedded to your Mobile Device at Samsung’s costs. In this regard, Maxis does not assume or undertake any risks, liabilities, roles and/or responsibilities in respect of Samsung Care+ under this Campaign.
- Subject to your fulfilment of the terms and conditions of this Campaign, particularly Clause 11 and Clause 12 above, you will be entitled to the Offer.
- By participating in this Campaign and accepting the Offer, you accept and agree to bound by the terms and conditions of Samsung Care+ as described in Clause 6 above.
- Your enjoyment of services under Samsung Care+ is subject to the applicable terms of Samsung Care+ as provided by Samsung and/or Tune. Maxis shall not be responsible or liable for any losses, damages, costs and/or expenses incurred by you and/or any third party and any difficulties or hardships you experience when requesting for services under Samsung Care+.
- Your entitlement to the Offer starts effectively from the date you collect your Mobile Device at one of our Maxis stores or receive the Mobile Device via delivery (if you have ordered online).
- Details of your entitlement to the Offer will be displayed in your Mobile Device within thirty (30) days from the date of collection of your Mobile Device. You may check your Samsung Care+ status on your phone setting. Go to Setting > About Phone > Samsung Care+. Once Samsung Care+ has been activated, you will be able to see the coverage period.
- This Offer is available on a first-come-first-serve basis, while stocks last.
Additional Terms
- Maxis is not an agent, subsidiary or affiliate of Tune and Samsung, and Maxis makes no representations or warranties as to, amongst others, the quality, merchantability, fitness of the Offer and Mobile Device and shall not be liable for any loss and damages suffered from the use of the Offer and Mobile Device.
- Maxis’ decision on the selection of participants who are eligible and entitled to the Offer shall be final and conclusive and Maxis shall entertain no correspondence, complaint, or appeal at any time during or after the Pre-Order Campaign Period.
- Maxis shall not be liable to the participants or any other party for any loss or damage of whatsoever nature suffered by a participant or such other party as a result of participation or non-participation in the Campaign or as a result of any act or omission on Maxis’ part.
- The Offer is not exchangeable for cash.
- Any Offer unutilized and/or unredeemed are not encashable, returnable and/or refundable.
- The terms and conditions stated herein shall be governed by the Laws of Malaysia and subject to the exclusive jurisdiction of the courts of Malaysia.
