Service Specific Terms & Conditions (“SSTC”) – Maxis Online Exclusive Offer for the Samsung Galaxy Unpacked

- The Campaign: Maxis Online Exclusive Offer for the Samsung Galaxy Unpacked.
- You: Person(s) who participates in the Campaign
- ROI Period: Refers to “Registration of Interest Period” and means the period of which you may register your interest for the Samsung Galaxy Unpacked device commencing on 7 January 2025 until 22 January 2025 (both dates inclusive).
- Campaign Period: Effective from 7 January 2025 until 14 February 2025 (both dates inclusive).
- By subscribing to the Campaign and use of the Service(s), you agree to be bound by these terms and conditions which shall form an integral part and to be read together with the General Terms & Conditions (“GTC”) at https://www.maxis.com.my/en/terms-conditions/personal/general/maxis-consumer/, this Service Specific Terms & Conditions – Maxis Online Exclusive Offer for the Samsung Galaxy Unpacked (“SSTC”), Summary Terms and Conditions (“STC”), Maxis Fair Usage Policy (“FUP”) at www.maxis.com.my/FUP and any other applicable terms and conditions, all available at www.maxis.com.my/terms-conditions/personal/.
- We are entitled at our discretion without liability, from time to time, to vary, add to, remove or otherwise amend these terms and conditions or any part thereof and/or withdraw or cancel this Campaign without any prior notice. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded.
- This Campaign is not valid in conjunction with other on-going offers, discounts, net-price products, rebates or privileges, unless otherwise allowed by Maxis.
- Our decisions in any matter in relation to this Campaign shall be final and conclusive and any request for appeal or review will not be entertained.
- All charges and prices stated are exclusive of all applicable taxes. Any applicable taxes shall be charged and added to the bills issued to you.
- Capitalised terms herein have the same meaning as defined in the GTC.
- Any conflict or inconsistency between this SSTC, the GTC and STC, shall be construed in the following order of precedence: (a) SSTC; (b) GTC; and (c) STC.
- If any of the provision in these terms and conditions is held to be invalid, illegal and unenforceable under any applicable law or court of law or by any reasons whatsoever, the legality and enforceability of the remaining provisions shall not be affected or impaired in any way and such invalid, illegal or unenforceable provision shall be deemed deleted.

- In order to participate in the Campaign and be eligible for the Benefit (as stated in Clause 21), you must be a new or existing customer of Maxis who:
- is at least 18 years of age;
- has registered your interest on the Samsung Galaxy Unpacked in Maxis Online Store at www.maxis.com.my or Maxis Mini Program App within the TNG eWallet app at https://touchngoewallet.onelink.me/8mmV/maxismpsm during the ROI Period; and
- ports-in to Maxis and/or signs up for new Maxis Postpaid plan(s) and any of the following contracts with the Samsung Galaxy Unpacked device(s) during the Campaign Period:
- Maxis Device Contract ; or
- Maxis Zerolution.
- You accept and agree to be bound by the terms and conditions of the relevant Maxis Postpaid plan(s) accessible at https://www.maxis.com.my/en/terms-conditions/products-services/mobile/postpaid/ and the relevant contract(s) which you signed up for. In addition:-
- If you sign up for Maxis Device Contract, you accept and agree to its terms and conditions at https://www.maxis.com.my/en/terms-conditions/personal/devices/contract/device-contract/; or
- If you sign up for Maxis Zerolution, you accept and agree to its terms and conditions at https://www.maxis.com.my/en/terms-conditions/devices/contract/zerolution/.
- If you sign up for Maxis Device Contract, you accept and agree to its terms and conditions at https://www.maxis.com.my/en/terms-conditions/personal/devices/contract/device-contract/; or
- You are ineligible for the Campaign if you have any outstanding payments with us.
- The Campaign is inapplicable to you if you are a commercial user and/or bulk subscriber.
- Notwithstanding the above, your eligibility to participate in the Campaign and the giving out of the Benefit are subject to our absolute discretion.
- In order to participate in the Campaign and be eligible for the Benefit (as stated in Clause 21), you must be a new or existing customer of Maxis who:

- You understand and agree that registration of your interest over the Samsung Galaxy Unpacked device(s) at Maxis Online Store at www.maxis.com.my or Maxis Mini Program App within the TNG eWallet app at https://touchngoewallet.onelink.me/8mmV/maxismpsm and submission of the ROI form to Maxis DO NOT constitute a booking or reservation of the Samsung Galaxy Unpacked device(s). You are required to pre-book and purchase the Samsung Galaxy Unpacked device(s) with Maxis during the Campaign Period in accordance with Clause 9 above.
- You understand and agree that you are solely responsible to pre-book, place order and make purchase of the Samsung Galaxy Unpacked device(s) with Maxis during the Campaign Period, and Maxis is not and shall not be responsible to ensure that you do the same.

- You are responsible for payment of all Charges associated with Maxis Postpaid plan(s) and contract(s) you signed up for pursuant to 9 above both during and after the Campaign Period. Charges exclude applicable taxes.

- Subject to the fulfilment of the terms and conditions of this Campaign and upon successful registration of your Maxis Postpaid plan(s) and contract(s) specified in Clause 9 and Clause 10 above with the Samsung Galaxy Unpacked device, you will enjoy a RM200 Touch ‘n Go eWallet credit (the “Benefit”) which will be given to you in accordance with the terms below:
- Benefit will be given on a “first come first serve” basis to the first 200 eligible participants who fulfil all the conditions stated in Clause 9 and Clause 10 above;
- In respect of the Benefit:
- You are required to install Touch ‘n Go app and register for Touch ‘n Go e-Wallet with your mobile phone number used to register and sign up for the Maxis Postpaid plan(s) and contract(s) under this Campaign (“Registered Mobile Number”) in order to receive the Benefit.
- Maxis will cause the Benefit to be credited into the relevant recipients’ Touch ‘n Go e-Wallet account by 6 March 2025. Recipients of the Benefit will be able to verify Maxis’ fulfilment of the Benefit by checking his/her e-Wallet balance and/or transaction history in his/her Touch ‘n Go account.
- In the event Maxis’ attempt to fulfil the Benefit on 6 March 2025 is unsuccessful, Maxis will send a SMS to the recipient’s Registered Mobile Number notifying the same and re-attempt crediting the Benefit twice on a weekly basis (i.e., by 13 March 2025 and 20 March 2025 respectively). The last fulfillment date of the Benefit is on 27 March 2025 (“Last Fulfillment Date”).
- In the event all three (3) attempts made by Maxis to credit the Touch ‘n Go Benefit (as described in Clause 18(b)(ii) and Clause 18(b)(iii) above) are unsuccessful, it shall constitute, and be deemed as, a waiver on the part of the relevant recipient(s) to receive the Benefit and the relevant recipient(s) shall relinquish all of his/her rights and entitlement in relation to the same. In this regard, Maxis shall be entitled to forfeit the Benefit and Maxis shall not be liable or responsible for any claims or whatsoever in relation to and/or arising from the Benefit.
- Subject to the fulfilment of the terms and conditions of this Campaign and upon successful registration of your Maxis Postpaid plan(s) and contract(s) specified in Clause 9 and Clause 10 above with the Samsung Galaxy Unpacked device, you will enjoy a RM200 Touch ‘n Go eWallet credit (the “Benefit”) which will be given to you in accordance with the terms below:

- During the Campaign Period to the Last Fulfilment Date, you shall NOT:
- terminate or suspend the relevant Maxis Postpaid plan(s) and contract(s) which you have registered;
- fail to activate the relevant Maxis Postpaid plan(s) and contract(s) which you have registered;
- change or transfer ownership of the Samsung Galaxy Unpacked device(s) which you have purchased to another person; and
- change or transfer ownership of the registered Maxis Postpaid plan(s) and contract(s) to another person.
- If any of the events in Clause 18 above occur, you will no longer be entitled to the Benefit.
- During the Campaign Period to the Last Fulfilment Date, you shall NOT:

- Maxis reserves the right to forfeit the Benefit if our attempt to fulfil the Benefit fails for any reason whatsoever.
- Maxis’ decision on the selection of participants who are eligible and entitled to the Benefit shall be final and conclusive and Maxis shall entertain no correspondence, complaint, or appeal at any time during or after the Campaign Period.
- Maxis shall not be liable to the participants or any other party for any loss or damage of whatsoever nature suffered by a participant or such other party as a result of participation or non-participation in the Campaign or as a result of any act or omission on Maxis’ part.
- The Benefit is not exchangeable for cash.
- Only one (1) Benefit will be given as follows:
- for Maxis Device Contract, per each Mobile Station Integrated Services Digital Network (MSISDN) new subscription and activation; and
- for Maxis Zerolution, per each Mobile Station Integrated Services Digital Network (MSISDN) new subscription and activation.
- Any Benefit unutilized and/or unredeemed are not encashable, returnable and/or refundable.
- Maxis is not an agent, subsidiary or affiliate of Touch ‘n Go and make no representation or warranties as to the quality, merchantability, fitness of the Benefit and shall not be liable for any loss and damages suffered from the use of the Benefit.
- The terms and conditions stated herein shall be governed by the Laws of Malaysia and subject to the exclusive jurisdiction of the courts of Malaysia.
