Terms and Conditions
   
Hotlink Rewards is a programme where Hotlink prepaid subscribers who are registered with Maxis Mobile Services Sdn Bhd may participate in this Programme to redeem call credits, and m-vouchers for redemption of Hotlink Rewards Redemption Items made available from time to time under the Programme with points earned.
   
1. DEFINITIONS
   
1.1 For the purposes of these Terms and Conditions, the following capitalized terms shall, unless otherwise specified, bear the following meanings :-

"call credit(s)" means the airtime purchased by Subscribers when they Top Up their Hotlink Account.

"Hotlink" is the brand name of the prepaid mobile telecommunication services provided by MMSSB, subject to the Hotlink Service Terms & Conditions.

"Hotlink Account" shall have the same meaning as "Account" defined in the Hotlink Service Terms & Conditions.

"Hotlink Rewards Redemption Items" means Hotlink Starter Kits, Top Up Tickets, mobile phone rebates at participating MEPs dealers and/or other products that may be introduced from time to time.

"Hotlink Service Terms & Conditions" refer to the terms and conditions for the Hotlink prepaid services, which is included in the Starter Kit purchased by the Subscriber or can be viewed at www.hotlink.com.my.

"MMSSB" refers to the Maxis Mobile Services Sdn Bhd (73315-V).

"MEPs" are Maxis Exclusive Partners.

"m-voucher(s)" are electronic vouchers which can be acquired via SMS and is/are used for redemption of Hotlink Rewards Redemption Items and mobile phones at MEPs outlets.

"Participant(s)" refer to Subscriber(s) who is/are successfully registered with the Programme.

"Programme" means customer loyalty programme known as "Hotlink Rewards".

"Reward Points" refers to points accumulated for each successful top up

"SMS" means Short Message Service.

"Subscriber" means an individual subscribing to the Hotlink prepaid services, which is governed by the Hotlink Service Terms & Conditions.

"Top Up" means the act of reloading using a Top Up Ticket or a reload voucher in any form, whether written or electronic, issued and delivered to the Participant for the purposes of redeeming call credits and m-vouchers offered under the Programme except for those Subscribers using "share-a-load" top up and travellers packs.

Words capitalised but not defined in these terms and conditions shall take the same meaning as those defined in the Hotlink Service Terms & Conditions.

   
2. ELIGIBILITY
   
2.1 To be eligible to participate in the Programme, Subscribers must :
  1. Have an active Hotlink Account
  2. top up an aggregate value of at least RM30.00 per month;
  3. register by submitting their personal particulars (as per NRIC) via SMS.
   
3. ISSUANCE AND REDEMPTION OF HOTLINK REWARD POINTS
   
3.1 Participants will be awarded with points for every successful top up meeting the eligibility criteria. Points awarded will also depend on the number of years the subscriber has been a Hotlink customer with MMSSB.
   
3.2 This programme is open to all forms of top up channels with exception to 'share-a-load' service and travellers packs.
   
3.3 Programme subscribers have an option to redeem the following choice of rewards :
  1. call credits
  2. m-vouchers
   
3.4 m-vouchers can only be used for redemption of Hotlink Rewards Redemption Items. A minimum of 5000 Reward Points would be required for redemption of m-vouchers and the m-vouchers would be in a denomination of RM50.00. Participants may choose to pay the price differential for Hotlink Rewards Redemption Items which are higher than the value of the m-voucher.
   
3.5 Reward Points can only be used to redeem call credits or m-vouchers in respect of Hotlink Rewards Redemption Items listed in www.hotlink.com.my, which may be updated from time to time.

Reward Points cannot be redeemed until credited to the Participant's Reward Points account.
   
3.6 Only Participants with sufficient Reward Points are eligible to redeem and he/she may do so using the various redemption methods implemented or to be implemented by MMSSB. Participants are required to send an SMS via a short code prior to the redemption of call credits or m-vouchers.
   
3.7 After receiving Participants' request for redemption via SMS as described above, MMSSB will send an SMS confirmation of the selected redemption. If the Participant has insufficient points to make a redemption, MMSSB will send an SMS notification informing the Participant of the same.
   
3.8 Once the call credit or m-vouchers have been redeemed, the corresponding Reward Points would be deducted accordingly from the Participant's Reward Points account.
   
3.9 Redemption orders once accepted by MMSSB (wherein Participants will receive the SMS confirmation) cannot be revoked, cancelled, returned or exchanged, and the affected Reward Points will not be reinstated to the Participants.
   
3.10 MMSSB shall not be liable in any way for failures, defects or delays in the delivery of a response for any reason whatsoever. The Participant is responsible for all charges incurred if the Participant accidentally erases, replaces or deletes any of the responses by receiving another response or otherwise.
   
3.11 Reward points will be accumulated on a monthly basis and redemption of call credits and m-vouchers can only be redeemed on a quarterly basis wherein the information regarding the window for redemption will be communicated through www.hotlink.com.my.
   
3.12 Reward points not utilized within the redemption month would be carried forward in the subsequent window for redemption.
   
3.13 If Participants do not redeem call credits or m-vouchers, their Reward Points will be automatically forfeited within two (2) years from the date of Reward Points earned in the Programme as determined by MMSSB.
   
3.14 Reward Points status will be updated, awarded and reflected via SMS each time they are redeemed. Details provided via SMS are the date of redemption, Reward Points redeemed as at the last redemption and total available Reward Points.
   
3.15 In cases where Participants have more than one (1) Hotlink Account, points for all Hotlink Accounts cannot be accumulated and reflected in a designated Hotlink Account.
   
3.16 Points of one (1) Participant cannot be combined with that of other Participants and is not transferable between Participants.
   
3.17 Any Reward Points earned prior to a migration to a postpaid service plan will not be carried or transferred to the postpaid account.
   
3.18 Reward Points cannot be transferred from a Participant to an individual (assuming the role of a new Subscriber) who has taken over the Participant's Hotlink Account. For the avoidance of doubt, in order for the new Subscribers taking over a Participant's Hotlink Account to enjoy benefits of the Programme, the new Subscriber must register with the Programme.
   
3.19 Participants may visit www.hotlink.com.my or call our Maxis Call Centre at 1300820120 to get regular updates.
   
3.20 The Participant shall bear full responsibility for the safe keeping and use of the Reward Points allotted to him/her.
   
3.21 Hotlink Rewards Redemption Items featured in www.hotlink.com.my are subject to availability. MMSSB reserves the right, at its absolute discretion, to set any quota for, or replace or withdraw any rewards at any time.
   
3.22 The redemption of call credits or m-vouchers are subject to these Terms and Conditions and any other Terms and Conditions set by MMSSB (including but not limited to the Hotlink Service Terms and Conditions) and/or the relevant merchants as listed in www.hotlink.com.my.
   
3.23 MMSSB shall be under no obligation whatsoever to process a Programme Subscriber's application for the redemption of call credit or m-vouchers if there are insufficient Reward Points for the redemption requested.
   
3.24 Call credits or m-vouchers are neither refundable nor exchangeable for cash or credit unless otherwise stated. MMSSB reserves the right to substitute the Participant's choice of rewards with rewards of at least an equivalent value.
   
3.25 Receipt of m-voucher for redemption of items does not constitute a reservation. The Participant is responsible for making the necessary enquiry on the availability of redemption items with the participating MEPs outlets listed in www.hotlink.com.my and presenting the m-voucher to the participating MEPs outlets upon redemption. m-voucher redemptions are applicable for Hotlink Rewards Redemption Items (if any) only unless otherwise specified and is subject to availability.
   
3.26 MMSSB shall not be obliged to extend, replace, refund, re-allocate or entertain any requests for changes to m-vouchers once m-vouchers have been utilized, unless otherwise stipulated by MMSSB.
   
3.27 M-vouchers are valid for thirty (30) days from the date of issue unless otherwise stated. MMSSB shall not be under any obligation whatsoever to extend the validity of the m-vouchers or reinstate the Reward Points.
   
3.28 Any tax arising from a Participant's participation in the Programme is the responsibility of the Participant.
   
3.29 Participants may be introduced to other methods by which the Participant may be able to receive Reward Points from MMSSB, which will be announced from time to time.
   
3.30 MMSSB may introduce other methods of redemption, which will be announced from time to time.
   
4. RESPONSIBILITY OF THE PARTICIPANT
   
4.1 It is the responsibility of the Participant to notify MMSSB, being the administrator of the Program, of:
  1. any change(s) to the Participant's particulars and information;
  2. any disputes in relation to Reward Points awarded to the Participant within two (2) days from request date of the Reward Points checking, failure of which may be relied on by MMSSB to constitute conclusive evidence against the Participant of the truth and accuracy of the items and entries stated therein.
   
4.2 All notifications must be made via email, in writing, call in to MMSSB or through www.hotlink.com.my
   
5. SUSPENSIONS AND TERMINATION
   
5.1 MMSSB reserves the right to suspend or terminate the Participant's participation to the Programme, as the case may be, based on circumstances including but not limited to:
  1. termination of Participant's Hotlink Account, including without limitation as a result of a transfer of Hotlink Account;
  2. termination of the Programme:
  3. Breach by the Participant of any of these Terms and Conditions and Hotlink Service Terms & Conditions;
  4. supplies any misleading information or makes any misrepresentations to MMSSB in connection with the Programme;
  5. abuses any privilege accorded to the Participant under the Programme;
  6. engages in any fraudulent activities under the Programme;
  7. is deceased or is declared a bankrupt;
  8. displays inappropriate behavior against any member of MMSSB staff;
  9. Any other circumstances as determined by MMSSB.
   
5.2 In the case of termination of the Hotlink Account, the Participant shall NOT be entitled to redeem remaining Reward Points and any unused Reward Points will expire.
   
5.3 Participants may at any time terminate his/her participation by giving notice to MMSSB.
   
5.4 Termination of Participant's participation by MMSSB shall take effect immediately without notification.
   
6. CONSENT TO USE AND DISCLOSE INFORMATION AND DATA
   
6.1 MMSSB respect the privacy of its Participants.
   
6.2 Any information disclosed by the Participant may be used by, and shared between MMSSB and its group of companies or any other parties where necessary to operate the Programme in order to provide Participants with Hotlink Rewards Redemption Items and services relating to the Programme, to communicate with Participants, to promote offers to Participants, to fulfil Participants' request including redemption orders and for identification purposes.
   
6.3 From time to time, MMSSB may ask for additional information, to help improve its service to the Participants, to create more opportunities for Participants to enjoy the Programme, to follow up with Participants indirectly through its database such as customer profile and consumer behaviour.
   
6.4 Any customer information (including Participants' name and contact details) may be used to analyse Participants' activities on the Programme.
   
6.5 MMSSB may also use that information, share it with its group of companies and any other parties in order to facilitate various services to the Participants, to extend Participant benefits and special offers, and for marketing purposes including planning, product development, telemarketing promotions, research and other carefully screened marketing programmes or activities, which MMSSB believe may interest the Participants.
   
6.6 Participants shall ensure that all personal detail provided to MMSSB is accurate at the point of submission and that MMSSB is kept informed and updated of any change in their personal details.
   
6.7 If for any reason a Participant believes that his/her personal information lodged with MMSSB is inaccurate or if a Participant would like to change and reconfirm his/her personal information, they can contact Maxis Call Centre at 1 300 820120.
   
6.8 The Participant agrees that MMSSB shall be entitled to use or disclose any information or data disclosed by the Participant in accordance with these Terms and Conditions and those defined in the Hotlink Service Terms & Conditions.
   
6.9 MMSSB endeavours not to disclose any personally identifiable information to any organisation unless necessary to operate the Programme and/or if MMSSB is legally required to do so by law. Participants will be treated as having given permission for disclosures herein referred.
   
7. OTHERS
   
7.1 MMSSB gives no representation or warranty with respect to any Hotlink Rewards Redemption Items featured in the Programme or other channels of redemption. In particular, MMSSB gives no warranty with respect to the quality of the Rewards Redemption Items or their suitability for any purpose. However, Participants may liaise directly with the supplier of the product according to the warranty awarded.
   
7.2 m-vouchers are valid for use only at participating MEPs outlets or suppliers as mentioned on the m-vouchers and only for specific matters mentioned therein. The m-vouchers are valid for use until the date specified and subject to the terms and conditions therein. If the m-vouchers remain unused after the date specified, the m-voucher will lapse and will not be replaced.
   
7.3 MMSSB's decision on all matters pertaining to the Programme is final.
   
7.4 MMSSB reserves the right to amend, vary or supplement these Terms and Conditions herein, including without limitation the list of Hotlink Rewards Redemption Items, Rewards Points (which includes its points structure and mechanism), the Programme, window for redemption and the amount of Top Up, without giving notice to Participants and such amendments, variation or supplements shall take effect from the date specified in such notices or in the absence thereof, as from the date such notices are released. All Participants shall be bound by any such variations or terminations. The Participants shall update themselves with such amendments by referring to the Terms and Conditions which is made available at www.hotlink.com.my.
   
7.5 A notice shall be deemed to be given by MMSSB to a Participant if it is posted to the address of the Participant appearing in MMSSB records or published in the media or on www.hotlink.com.my.
   
7.6 In no event shall MMSSB, its affiliated or related corporations, their respective agents, representatives or business partners be liable to any Participant or any third party authorized by or claiming through a member whether in contract or tort for any loss or damage, direct or indirect, special or consequential or of any nature suffered by any Participant resulting from the use or inability to use any of the privileges attached to a Programme participation, including without limitation:-
  1. any injury or death;
  2. for any unauthorized use of membership;
  3. any unauthorized use of Reward Points or unauthorized sale of Reward Points;
  4. any unauthorized redemption of Reward Points;
  5. any product not being available for any reasons to redeem;
  6. any failure by any MEPs outlet or supplier to comply with terms and conditions in respect of supplying the m-vouchers / redeemable product;
  7. any failure by the Participant to comply with the terms and conditions on which it has been agreed to provide call credits / m-vouchers / Hotlink Rewards Redemption Items;
  8. the suspension or termination of the Programme.
  9. any breach or failure by MMSSB or participating MEPs outlets to perform any of the obligations set out in these terms and conditions;
  10. any error, omission or inaccuracy in any information provided by MMSSB or participating MEPs outlets whether to the Participant or any person and whether in any publication or as part of or in connection with the implementation, administration or conduct of the Programme;
  11. any defect, deficiency, breakdown of MMSSB's or participating merchants' software or system or loss, corruption or deletion of data supplied by the customer.
  12. Hotlink Rewards Redemption Items and services provided under or in relation to this Programme, including all representations and/or warranties relating thereto.
    m. Any technical failure of system, including without limitation www.hotlink.com.my and SMS system which may impede a Participant's transaction.
   
7.7 All conditions and warranties, whether express or implied and whether arising under legislation or otherwise, as to the condition, suitability, quality, fitness or safety of any product supplied under the Programme are expressly excluded to the full extent permitted by law. Any liability MMSSB may have to a Participant under legislation in respect of such Hotlink Rewards Redemption Items which cannot be excluded is limited, where permitted, to supplying or paying the cost of supplying the Hotlink Rewards Redemption Items again or repairing or paying the costs of repairing the Hotlink Rewards Redemption Items as MMSSB's option. Participating MEPs dealers or suppliers do not have any authority, express or implied, to make any representation, warranty or statement on behalf of MMSSB.
   
7.8 MMSSB reserves the right to assign, novate or sell the Programme to another company whereby MMSSB transfers all rights and obligations under these Terms and Conditions without any further consent and may disclose or transfer all information held about Participants to a prospective or actual new owner. Such a disclosure or transfer may not alter the rights of the Participant to in respect of the use that can be made of such information by such other company.
