Service Specific Terms & Conditions – Outright Purchase for Devices and Accessories

    1. Outright Purchase: A one-time payment for selected mobile devices and accessories.
    2. You: Person(s) who make(s) an Outright Purchase with Maxis in accordance with the terms herein.
    3. Commencement Date: 12 September 2024.
    4. Device(s): Refers to selected smartphone models made available by Maxis for Outright Purchase, which may be changed any time and from time to time at Maxis' discretion.
    5. Accessory(ies): Refers to selected non-SIM based device(s) made available by Maxis for Outright Purchase, which may be changed any time and from time to time at Maxis' discretion.
    6. Product(s): Refers to Device(s) and Accessory(ies).
    7. Any Outright Purchase made under this Service Specific Terms & Conditions – Outright Purchase (“SSTC”) is subjected to Maxis’ General Terms & Conditions (“GTC”) at https://www.maxis.com.my/en/terms-conditions/general/maxis-consumer/, the Summary Terms & Conditions (“STC”) at https://www.maxis.com.my/en/terms-conditions/general/summary/, this SSTC and any other applicable terms and conditions, all available at https://www.maxis.com.my/en/terms-conditions/, which may be updated by Maxis from time to time.
    8. Capitalized terms have the same meaning as defined in the GTC.
    9. Any conflict or inconsistency between this SSTC, the GTC and STC, shall be construed in order of precedence: (a) SSTC; (b) GTC; and (c) STC.
    10. Maxis reserves the rights without liability, to revise this SSTC, the GTC, the STC and pricing. Where reasonably practicable, we will give reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information and changes to the Agreement regarding Outright Purchase at https://www.maxis.com.my/en/terms-conditions/.
    1. Only residents of Malaysia are eligible to make an Outright Purchase.
    2. You do not need to be a Maxis subscriber to make an Outright Purchase.
    3. Notwithstanding the above, Maxis reserves the right, at its sole discretion, to determine if you are suitable and/or eligible to make an Outright Purchase.
    1. The option to perform an Outright Purchase will be made available through in-store purchasing, online order via Maxis Online Store and in app order via Maxis App. Availability of any Products is subject to stock availability on each platform.
    2. Outright Purchase enables you to purchase any Products from Maxis without committing to any contracts or fulfilling any requirements under Maxis’ plans.
    3. You must make the full payment charged for an Outright Purchase of the Product upfront for immediate ownership of the Product.
    1. You are responsible for payment of the price charged for an Outright Purchase of the Product. Charges exclude applicable taxes.
    1. Maxis reserves the right to suspend or terminate the availability of the Outright Purchase option at any time without prior notice to you.
    2. The list of Products available for Outright Purchase may be changed by Maxis from time to time at its sole discretion.
    3. Maxis is not an agent, subsidiary or affiliate of the manufacturers of the Products, and Maxis makes no representations or warranties as to, amongst others, the quality, merchantability, fitness of the Products and shall not be liable for any loss and damages suffered from the use of the Products.
    4. Maxis’ decision on the selection of customers who are eligible and entitled to make an Outright Purchase shall be final and conclusive and Maxis shall entertain no correspondence, complaint, or appeal at any time during the availability of the Outright purchase option.
    5. The terms and conditions stated herein shall be governed by the laws of Malaysia and subject to the exclusive jurisdiction of the courts of Malaysia.
