Service Specific Terms & Conditions (“SSTC”) – Maxis Home 4G WiFi Device Contract

- The Offer: Maxis Home 4G WiFi Device Contract.
- You: Person(s) signing up for the Offer.
- By accepting this Offer, you will enjoy one (1) home modem OR home router ("Device") at the price stipulated for the particular device.
- The Offer can only apply to Maxis Home WiFi 138 (previously known as Maxis Home 4G WiFi 138).
- The Offer and use of the Service(s) under the Offer is subject to the General Terms & Conditions ("GTC"), this Service Specific Terms & Conditions ("SSTC"), Service Specific Terms & Conditions - Maxis Home WiFi (“Maxis Home WiFi SSTC”), Maxis Fair Usage Policy and any other applicable terms and conditions, all at www.maxis.com.my/terms-conditions/personal/
- All capitalised terms herein have the same meaning as defined in the GTC.
- Any conflict or inconsistency between this SSTC, Maxis Home WiFi SSTC, the GTC and Summary Terms and Conditions ("STC"), shall be construed in the following order of precedence: (a) this SSTC; (b) Maxis Home WiFi SSTC; (b) GTC; and (d) STC.
- We reserve the rights without liability, to revise this SSTC, the GTC, Offer and our pricing. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information on the Offer and Service(s) under the Offer at www.maxis.com.my/tnc, including changes to the Agreement. Your continued use of the Service(s), and/or Offer (after the Effective Date of any revision/change to the terms and conditions of the Agreement, Services, and/or Offer) shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same. If you do not accept such revisions/changes, you will terminate the Offer and/or the use of the Services under the Offer by giving us notice within 28 days from the Effective Date failing which you are assumed to have accepted the changes.

- The account for the Maxis Home WiFi 138 must be registered in your name and be an active account.
- You are not eligible for the Offer if you have any outstanding payments with us.
- The Offer is not applicable to you if you are a commercial user and/or bulk subscriber.
- Notwithstanding the above, Maxis reserves the right to change the eligibility criteria for the Offer from time to time.
- The account for the Maxis Home WiFi 138 must be registered in your name and be an active account.

- You are responsible for payment of all Charges associated with the Offer.
- The Charges and rate table guide for the rate plan under this Offer is as set out on our website at https://www.maxis.com.my/en/broadband/#home-wifi. Charges and rates displayed do not include any applicable taxes.
- You are responsible for payment of all Charges associated with the Offer.

- A deposit of RM300 is chargeable for non-Malaysians subscribing to the Offer.
- Advance payment based on the rate plan under this Offer is as set out on our website at https://www.maxis.com.my/en/broadband/#home-wifi

- This Offer is subject to a minimum of twelve (12) months contract period ("Minimum Commitment Period") commencing from the date you signed up for this Offer ("Date of Activation"). With the acceptance of the Offer, any previous device contract for a Device you had contracted for with Maxis, shall be deemed terminated as at the Date of Activation and you shall be subject to an early termination charges of such previous contract, if applicable.
- You shall NOT during the Minimum Commitment Period:
- terminate your Maxis Home WiFi 138 plan or account, unless it is terminated pursuant to Clause 21 below;
- suspend or cause your Maxis Home WiFi 138 account to be suspended;
- have your Maxis Home WiFi 138 account terminated for non-payment of monthly bills;
- change or transfer ownership of the Maxis Home WiFi 138 plan to another person.
- terminate your Maxis Home WiFi 138 plan or account, unless it is terminated pursuant to Clause 21 below;
- If any of the events in Clause 18 above occurs, the Offer will be terminated and you agree that Maxis has the right to impose an early termination charge on you if you terminate the Offer during the Minimum Commitment Period. The early termination charge is calculated based on the following:
[(Recommended Retail Price (RRP) – Upfront Cost) x (Remaining month(s) ÷ 12 months)]
Payment of the early termination charge is payable by you in addition to all monies owing to us up to the date of early termination.
- You acknowledge and agree that Maxis shall have the rights to block the IMEI of the Device if you are:
- suspected of fraud or found to have committed fraud; or
- after signing up to the Offer, you fail to make payment for a continuous period of three (3) months.

- Maxis may offer promotions and/or campaigns to its customers to sign up for Maxis Fibre plan, from time to time. You will be subject to the following if you switch or replace your existing Maxis Home WiFi 138 plan with a Maxis Fibre plan pursuant to such promotions / campaigns:
- new sign up of a Maxis Fibre plan (offered under such promotions / campaigns), subject to the Service Specific Terms & Conditions – Maxis Fibre Broadband (available at https://www.maxis.com.my/en/terms-conditions/products-services/home-internet/maxis-fibre/) and any terms & conditions applicable to such promotions / campaigns;
- termination of your existing Maxis Home WiFi 138 plan or account and the Offer; and
- there will be no early termination charge as per Clause 19, provided that your existing Maxis Home WiFi 138 plan was not a switch from or replacement of a Maxis Fibre plan previously due to a relocation of your Premises to a location which does not have Maxis Fibre service.
- new sign up of a Maxis Fibre plan (offered under such promotions / campaigns), subject to the Service Specific Terms & Conditions – Maxis Fibre Broadband (available at https://www.maxis.com.my/en/terms-conditions/products-services/home-internet/maxis-fibre/) and any terms & conditions applicable to such promotions / campaigns;
- This Offer is subject to a minimum of twelve (12) months contract period ("Minimum Commitment Period") commencing from the date you signed up for this Offer ("Date of Activation"). - The Device provided under the Offer are on a “while stock last” basis. We reserve the rights to change the Device model from time to time.
- We shall not be responsible for replacing your Device or any part thereof that is lost, stolen, damaged or defective. You shall be responsible for the repair and maintenance of your Device. Should a defect or fault fall within the ambit of manufacturer’s warranty, repairs shall be subject to the applicable warranty issued by the Device manufacturer. You accept and acknowledge that the Device is subject to the Device manufacturer’s standard warranty and we shall not be responsible and/or liable for the Device and/or for any loss and/or damage whatsoever suffered by you and/or any other party.
- The Device manufacturer’s warranty does not cover: (a) the SIM card and Device holder; (b) damage, loss or defects caused by any act, omission, misuse, negligence including usage of the Device contrary to instructions provided by Maxis or the manufacturer (as set out in the Device’s user guide); and/or (c) other acts beyond our reasonable control.
- Please visit your nearest Maxis Centre should you have any issues with the Device.
- If you discontinue the Plan before the Minimum Commitment Period ends, you do not need to return the Device, however you expressly agreed that we will impose you the early termination charge as stated in Clause 19.
- The Device provided under the Offer are on a “while stock last” basis. We reserve the rights to change the Device model from time to time.

- The Offer cannot be exchanged for cash and the Device is not returnable upon acceptance.
- We reserve the rights to rescind any of the benefit(s) under this Offer in the event your Maxis Home WiFi 138 plan/account registered for the Offer is not used with the Device purchased.
- You can only sign up for one (1) Offer for each Maxis Home WiFi 138 plan registered.
- Your device advance payment will be rebated into your bill based on the Offer.
- Your Maxis Home WiFi 138 plan/account must be active for you to be able to receive the device advance payment refund. Where your line is suspended, terminated or barred, you will not be entitled to receive the said advance payment refund.
- The Offer cannot be exchanged for cash and the Device is not returnable upon acceptance.

- Subject to our GTC, the account holder of the Maxis Home WiFi 138 may at any time terminate the Offer as follows:
- by calling our customer care line at 1-800-82-1123 or dial 123 from your mobile;
- by walking into our Maxis Centres listed on www.maxis.com.my; or
- by writing in to customercare@maxis.com.my
- by calling our customer care line at 1-800-82-1123 or dial 123 from your mobile;
- Subject to our GTC, the account holder of the Maxis Home WiFi 138 may at any time terminate the Offer as follows:

- A minimum 3-month waiting period is applicable to you for this Offer if you are an existing customer of Maxis eligible to take up more than 1 device contract under the same Malaysian identity card number or passport number. Each device contract must be 3 months apart.
