Service Specific Terms & Conditions ("SSTC") - Maxis Home WiFi (previously known as Maxis Home 4G WiFi)

- The Plan: Comprises of
- Maxis Home WiFi 68 (available before 7th March 2024 only);
- Maxis Home WiFi 138 (previously known as Maxis Home 4G WiFi 138) (available before 7th March 2024 only);
- Maxis Home WiFi 158 (available before 7th March 2024 only);
- Maxis 5G Home WiFi 69;
- Maxis 5G Home WiFi 99; or
- Maxis 5G Home WiFi 139.

- The Plan and use of the Service(s) under the Plan is subject to the General Terms & Conditions ("GTC"), this Service Specific Terms & Conditions ("SSTC"), the Summary Terms and Conditions ("STC"), Maxis Fair Usage Policy and any other applicable terms and conditions, all at www.maxis.com.my/terms-conditions/personal/
- All capitalised terms herein have the same meaning as defined in the GTC.
- Any conflict or inconsistency between this SSTC, the GTC and STC, shall be construed in the following order of precedence: (a) SSTC; (b) GTC; and (c) STC.
- We reserve the rights without liability, to revise this SSTC, the GTC, Plan and our pricing. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information on the Plan and Service(s) under the Plan at www.maxis.com.my/tnc, including changes to the Agreement. If you do not accept such revisions/changes, you are required to terminate the Plan and/or the use of the Services under the Plan in accordance with Clause 21 by giving us notice within 28 days from the Effective Date failing which you are assumed to have accepted the changes. Save where terminated based on the foregoing, any continued use of the Service(s), and/or the Plan (after the Effective Date of any revision/change to the terms and conditions of the Agreement, Services, and/or Plan) shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same.
- The Plan: Comprises of

- You are not eligible for the Plan if you have any outstanding payments with us.
- This Plan is not applicable to you if you are a commercial user and/or bulk subscriber.
- Notwithstanding the above, Maxis reserves the right to change the eligibility criteria for the Plan from time to time.

- The applicable Charges and rate table guide for the rate plan under the Plan are as set out on our website at
https://www.maxis.com.my/en/broadband/#home-wifi and in the Appendix. Charges and rates displayed do not include any applicable taxes. - You are responsible for payment of all Charges associated with the Plan.

- A deposit of RM300 is chargeable for non-Malaysians subscribing to the Plan.
- We may collect from you advance payment, based on the rate plan under the Plan that you have signed up to. If such advance payment is applicable, such advance amount will be refunded to you by way of rebate directly to your monthly bill or such other manner as Maxis deems fit.

- The mobile internet data allocated within the Services under the Plan is exclusively for domestic usage only. International / overseas roaming is not applicable for the Plan.
- There is no guarantee of speed. Availability of the Services under the Plan depends on Maxis mobile data coverage, which you may refer to at this website (https://www.maxis.com.my/en/about-maxis/maxis-network/network-map/).
- The mobile internet data allocation for the Plans is specified in the Appendix and you acknowledge and agree that:
- For Maxis Home WiFi 68 Plan: Once your allocated mobile internet data finishes, the speed will be managed to a lower speed until your next billing cycle. To continue enjoying the Service under the Plan at regular speeds, you may purchase one-time passes (non-recurring) through your Maxis app accessible through your Mobile Device or Maxis Care Portal (maxis.com.my).
- For Maxis Home WiFi 138 Plan: For the mobile internet data allocated with this Plan, you acknowledge and accept if your data usage exceeds 300GB in a month, Maxis may at its absolute discretion limit the quality of video streaming to standard definition during peak hours.
- For Maxis Home WiFi 158 Plan: For the mobile internet data allocated with this Plan, you acknowledge and accept if your data usage exceeds 500GB in a month, Maxis may at its absolute discretion limit the quality of video streaming to standard definition during peak hours.
- For Maxis 5G Home WiFi 69 Plan: Once your allocated 5G mobile internet data finishes, the speed will be managed to a lower speed until your next billing cycle. To continue enjoying the Service under the Plan at regular speeds, you may purchase one-time passes (non-recurring) through your Maxis app accessible through your Mobile Device or Maxis Care Portal (maxis.com.my).
- For Maxis 5G Home WiFi 99 Plan: For the 5G mobile internet data allocated with this Plan, you acknowledge and accept if your 5G data usage exceeds 1000GB in a month, Maxis may at its absolute discretion limit your usage by reducing the speed until your next billing cycle.
- For Maxis 5G Home WiFi 139 Plan: For the 5G mobile internet data allocated with this Plan, you acknowledge and accept if your 5G data usage exceeds 1000GB in a month, Maxis may at its absolute discretion limit your usage by reducing the speed until your next billing cycle.
- For Maxis Home WiFi 158 Plan, Maxis 5G Home WiFi 69 Plan, Maxis 5G Home WiFi 99 Plan and Maxis 5G Home WiFi 139 Plan: :
- you further acknowledge and agree that:
- The 5G services is only available within the 5G network coverage area via use of the Router (as defined below). Customers using the Services outside the 5G network coverage areas will have their 5G services automatically switched to 4G services or any of Maxis’ other available networks. A map of 5G network coverage area can be found at https://www.maxis.com.my/en/about-maxis/5g-network/#coverage; and
- The 5G services may be subject to other terms, conditions or stipulations as may be prescribed by the Ministry of Communications and Multimedia, the Malaysian Communications and Multimedia Commission and/or Maxis’ third party service provider of the national 5G wholesale network from time to time.
- Maxis does not represent, warrant, undertake and/or guarantee that the 5G services will be:
- provided without errors;
- uninterrupted; and/or
- that your experience of the existing services which you are subscribing from Maxis on our other available networks will not be impacted in an adverse manner, and that Maxis will and is able to correct or rectify all or any part of the errors or interruption. You understand and acknowledge that the 5G services may be subject to limitations, delays and other problems inherent in communication facilities and network and or the third party 5G network, including the internet and Maxis shall not be responsible to you and/or any third party for any delays, delivery, failures, or other damage or loss resulting from or in connection with such problems.
- Without derogating from the disclaimers and limitation of liability under the GTC which are applicable to you, Maxis makes no representation or give any condition, indemnity, warranty, guarantee, whether express or implied, about whether the 5G services will operate and be compatible with any Content, Equipment, hardware or software or that it will be compatible with the national 5G wholesale network. You acknowledge and agree that Maxis relies on one or more third party service providers in relation to the Plan (including its availability and continuity) and as such, to the fullest extent permitted by law, Maxis excludes any liability and shall not be liable to you and/or any third parties whether in contract, tort or otherwise for any loss, damage or liability incurred or sustained by you and/or any third party (including loss of revenue or loss of services or connectivity) caused by or in relation to any delay, failure, breakdown, inability to use or access, interruption or disruption by any of our third party service providers including Maxis’ third party provider of the national 5G wholesale network or in respect of interruption or adverse impact to existing services subscribed from Maxis arising from your subscription of the Plan.
- Notwithstanding anything to the contrary in this SSTC, you acknowledge and agree that:
- you have not relied on any representation, warranty, statement or similar made by Maxis’ third party service provider of the national 5G wholesale network in connection with your decision to use or the manner in which you will make use of the Plan and/or 5G services including where such Plan and/or 5G services is provided to you as part of products or services (or bundled products or services) by Maxis;
- you are solely responsible for your decision to use, and the manner in which you will make use of, the Plan and/or 5G services and does so at your own risk (including where the Plan and/or 5G services is used in connection with the preservation of life or property);
- you are solely responsible for making your own decisions on appropriate alternative redundancy, connectivity and data solutions in the event the Plan and/or 5G services is unavailable, disrupted or operate with error;
- the Plan and/or 5G services will not necessarily operate without error and will not always be available;
- Maxis’ third party service provider of the national 5G wholesale network does not owe you any duty of care or similar duty and you release Maxis’ third party service provider of the national 5G wholesale network from any liability arising from your use of the Plan and/or 5G services; and
- you must not do anything that may interfere with Maxis’ third party service provider of the national 5G wholesale network and/or connect or knowingly permit any third party to connect any equipment to the 5G network.
- you further acknowledge and agree that:
- For Maxis 5G Home WiFi 69, 99 and 139 Plans :
- Once your allocated 5G data finishes or if you are not in 5G coverage area,
- You will tap into your 4G Backup data allocation, with the allocated data and speeds specified in the Appendix;
- Once your allocated 4G Backup data finishes, the speed will be managed to a lower speed until your next billing cycle. To continue enjoying the Service under the Plan at regular speeds, you may purchase one-time passes (non-recurring) through your Maxis app accessible through your Mobile Device or Maxis Care Portal (maxis.com.my).
- Once your allocated 5G data finishes or if you are not in 5G coverage area,
- For Maxis Home WiFi 158 Plan :
- Maxis 5G Router and SIM Card
- You will be provided with one (1) unit of 5G router (“Router”) as part of the Plan and a SIM Card to be used with the Router. You must not remove or allow anyone to remove the SIM Card from the Router. Should the SIM Card be removed from the Router and used on any other device apart from the Router provided under this Plan, Maxis reserves the right to block the SIM Card or Services. For the avoidance of doubt, only Maxis SIM Card can be used with the Router.
- We reserve the right to decide on the Router model from time to time.
- You are responsible, at all times, for the safety of Router.
- Should a defect or fault fall within the ambit of the Router’s manufacturer’s warranty, repairs shall be subject to the applicable warranty issued by the Router’s manufacturer. You accept and acknowledge that the Router is subject to the Router’s manufacturer’s standard warranty and we shall not be responsible and/or liable for the Router and/or for any loss and/or damage whatsoever suffered by you and/or any other party.
- The Router’s manufacturer’s warranty does not cover: (i) the SIM Card; (ii) damage, loss or defects caused by any act, omission, misuse and/or negligence including usage of the Router contrary to instructions provided by Maxis or the manufacturer (as set out in the Router’s user guide); and/or (iii) other acts beyond our reasonable control.
- For issues with the Router or for assistance on other technical matters relating to the Services, please call 1800 82 1123 from any line, or 123 from your Maxis mobile line.
- Commitment Period
- Maxis Home WiFi 158 Plan is subject to a minimum commitment period of twenty-four (24) months commencing from the activation date of the Plan (“158 Plan Commitment Period”).
- You shall NOT during the 158 Plan Commitment Period:
- terminate your Maxis Home WiFi 158 Plan;
- have the Service(s) under Maxis Home WiFi 158 Plan terminated for non-payment of monthly charges / bills;
- change or transfer ownership of Service(s) to another person; or
- downgrade your Maxis Home WiFi 158 Plan.
- If any of the events in Clause 19.2(b) occurs, we reserve the right to charge you the following early termination charge: [Monthly Charges (RM) x Remaining month(s) of the 158 Plan Commitment Period]
- For the avoidance of doubt, upon the expiry of the 158 Plan Commitment Period, the Service under the Plan shall continue automatically until you terminate the Service in accordance with this SSTC.
- Maxis 5G Router and SIM Card

- You must register your CBR (Can Be Reached) mobile number at point of sale at any Maxis Outlet or call our Contact Centre (123) from your mobile for such registration and keep your CBR mobile number updated so that any of our notice can reach you in timely manner.
- The SIM Card allocated to you for the Maxis Home WiFi 138, Maxis Home WiFi 158 Plan, Maxis 5G Home WiFi 99 Plan or Maxis 5G Home WiFi 139 Plan can be used with the modem provided (if you have signed up for the Maxis Home WiFi 158, Maxis Home 4G WiFi Device Contract Offer or Maxis 5G Home WiFi Device Contract Offer with Maxis, as the case may be) or other home wireless broadband devices.

- Subject to our GTC, the account holder of the Service(s) under the Plan may at any time terminate the Plan as follows:
- by calling our customer care line at 1-800-82-1123 or dial 123 from your mobile;
- by walking into our Maxis Centres listed on www.maxis.com.my; or
- by writing in to customercare@maxis.com.my
- Subject to our GTC, the account holder of the Service(s) under the Plan may at any time terminate the Plan as follows:

- For Maxis customers who subscribe to Maxis Home Zerolution (previously known as TV Zerolution) plan, you will be subject further to the Service Specific Terms & Conditions – Home Zerolution (“Home Zerolution SSTC”), available at https://www.maxis.com.my/en/terms-conditions/personal/broadband/home-zerolution/. Any conflict and inconsistency between this SSTC and the Home Zerolution SSTC, the Home Zerolution SSTC shall take precedence.

- Maxis Home 4G WiFi Bundle refers to the bundle tied to Maxis Home WiFi 138 Plan.
- Maxis Home 4G WiFi Bundle is available for purchase from Maxis participating retail and online partners and consists of (a) one (1) unit of 4G router; (b) one (1) 4G SIM Card; and (c) complimentary Maxis Home WiFi for 30 days (“Free WiFi Offer”) (collectively known as the “Maxis Home 4G WiFi Bundle”).
- If you wish to activate the 4G SIM Card and sign up for the Plan in the Maxis app, you must (a) create an account in the Maxis app; or (b) log-in your account in the Maxis app if you are an existing Maxis customer.
- Once you have successfully activated the 4G SIM Card and signed up for the Plan, (a) the Free WiFi Offer will automatically be assigned to your bill; and (b) the Free WiFi Offer will commence.
- Upon expiry of the Free WiFi Offer, you will remain on the Plan and be required to pay all Charges for the rate plan under the Plan until you terminate the Plan in accordance with this SSTC.

- During the process to activate the 4G SIM Card and sign up for the Plan in the Maxis app, you may choose to register for a 12-months’ commitment period for the Plan where you will enjoy RM20 rebate from your monthly Charges of the Plan for 12 months (“Rebate Contract”).
- Once you have successfully activated the 4G SIM Card and signed up for the Plan in Maxis app, (a) the Rebate Contract will commence for a period of 12 months (“Rebate Contract Commitment Period”); and (b) RM20 rebate under the Rebate Contract will be automatically assigned to your bill during Rebate Contract Commitment Period.
- For the avoidance of doubt, during the Rebate Contract Commitment Period, (a) you do not need to pay any Charges during the Free WiFi Offer period; and (b) you will start to pay the Charges (less the rebate) i.e. RM118 per month, after the expiry of the Free WiFi Offer.
- You shall not during the Rebate Contract Commitment Period:
- terminate your Maxis Home WiFi account;
- suspend or cause your Maxis Home WiFi account to be suspended;
- have the Service(s) terminated for non-payment of monthly charges / bills; or
- change or transfer ownership of Service(s) to another person.
- If any of the events in Clause 31 above occurs, it will be deemed as an early termination by you of the Rebate Contract and the following early termination charge based on the remaining of the Rebate Contract Commitment Period, calculated as follows will apply to you:
RM20 x Remaining month(s) of the Rebate Contract Commitment Period - Upon expiry of the Rebate Contract, you will remain on the Plan and be required to pay all Charges for the rate plan under the Plan.

- We reserve the rights at any time at our sole discretion whether with or without prior notice to you and without being liable to you or any third party, to immediately interrupt, bar, suspend or restrict the Service(s) for such time as we see fit or withdraw, terminate, discontinue or disconnect the Service(s) including if:
- any technical failure occurs in the Service(s) or our Network (which includes any network operated by any third party which are connected to Maxis’ network);
- the Service(s), our Network or systems are being upgraded, modified or maintained;
- your usage shows excessive usage or placing unusual burdens on our Network;
- in our determination that the Service(s) is or may be used by you for unlawful activities or for suspected fraudulent activities;
- your usage is not in accordance with the Maxis Fair Usage Policy (at www.maxis.com.my/FUP) or contrary to any of the terms and conditions of this SSTC and/or the GTC;
- your usage is for commercial, non-personal and/or reselling purposes;
- where matters beyond our reasonable control prevents us from performing and/ or continuing our obligations this SSTC, the GTC and/or the Maxis Fair Usage Policy;
- (for 5G services) you have relocated or have been relocated to an area outside the 5G network coverage area; or
- we are required to do so by law, statute, enactment, regulations, code or by any relevant authorities, including the Maxis’ third party service provider of the national 5G wholesale network, and where no prior notice is provided, Maxis may to the extent commercially and reasonably practicable give you notice of such changes in any form as Maxis deem reasonable or appropriate.
- In connection to any Service(s) survey, comments, suggestions and/or feedback submitted by you to Maxis, you agree that Maxis may use all comments, suggestions and feedback collected in any manner without restriction or obligation for any purpose, including but not limited to incorporation or implementation of such comments, suggestions and feedback into Maxis’ product or service, to develop, improve and/or evaluate the Services. Except for personal data, no comments, suggestions and/or feedback will be deemed as your confidential information.
- We reserve the rights at any time at our sole discretion whether with or without prior notice to you and without being liable to you or any third party, to immediately interrupt, bar, suspend or restrict the Service(s) for such time as we see fit or withdraw, terminate, discontinue or disconnect the Service(s) including if:
