Service Specific Terms & Conditions – Maxis Unlimited Postpaid and Fibre for Maxis Home Fibre Customers Campaign (“SSTC”)

Service Specific Terms & Conditions (“SSTC”) – Maxis Unlimited Postpaid and Fibre for Maxis Home Fibre Customers Campaign

    1. Campaign: Maxis Unlimited Postpaid and Fibre for Maxis Home Fibre Customers.
    2. You: Person(s) who is/are eligible to participate in this Campaign.
    3. Participating Maxis Plan(s): Maxis Postpaid 69, which applicable terms and conditions are at https://www.maxis.com.my/en/terms-conditions/products-services/mobile/postpaid-69-and-99/ (“Maxis Postpaid 69 & 99 SSTC”).
    4. Campaign Period: From 15th May 2024 until 31st December 2024 (both dates inclusive) or such other date or extension Campaign Period as may be determined by us.
    5. Reward(s): Subject to the terms and conditions of this SSTC, you are entitled to enjoy:
      1. Automatic upgrade to Maxis Unlimited Postpaid and Fibre, which applicable terms and conditions are at https://www.maxis.com.my/en/terms-conditions/products-services/mobile/maxis-unlimited-postpaid-fibre-plan/ ("Maxis Unlimited Postpaid and Fibre SSTC”) at the price of Maxis Postpaid 69 for life;
      2. Additional monthly Bill rebate of RM69 for a period of three (3) months from the activation of the Participating Maxis Plan if you Port-in to Maxis; and
      3. Monthly Bill rebate of RM20 to one (1) supplementary line you sign up for under Maxis Postpaid Share 48, which applicable terms and conditions are at https://www.maxis.com.my/en/terms-conditions/products-services/mobile/postpaid-share/ (“Maxis Postpaid Share 48 SSTC”). This Bill rebate applies for a period of twenty-four (24) months from the activation of the supplementary line.
    6. The Campaign and the use of the Service(s) are subject to the following:-
      1. the General Terms & Conditions (“GTC”) at https://www.maxis.com.my/en/terms-conditions/personal/general/maxis-consumer/
      2. this Service Specific Terms & Conditions – Maxis Unlimited Postpaid and Fibre for Maxis Home Fibre Customers Campaign (“SSTC”);
      3. Summary Terms and Conditions (“STC”) at https://www.maxis.com.my/en/terms-conditions/general/summary/
      4. Maxis Fair Usage Policy (“FUP”) at www.maxis.com.my/FUP and
      5. any other applicable terms and conditions, all available at www.maxis.com.my/terms-conditions/personal/
    7. Capitalised terms herein have the same meaning as defined in the GTC.
    8. Any conflict or inconsistency between this SSTC, the GTC and the Summary Terms and Conditions (“STC”), shall be construed in the following order of precedence: (a) SSTC; (b) GTC; and (c) STC.
    9. Further, by participating in the Campaign and signing up for Participating Maxis Plan, you acknowledge that you have read, accept and agree to be bound by the applicable terms and conditions as set out in Clause 5 above. For clarity, any conflict or inconsistency between this SSTC and the Maxis Postpaid 69 & 99 SSTC, Maxis Unlimited Postpaid and Fibre SSTC or Maxis Postpaid Share 48 SSTC, this SSTC shall take precedence.
    10. We reserve the rights without liability to revise this SSTC, the Rewards and our pricing. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information on this Campaign (at https://www.maxis.com.my/en/terms-conditions/promotions/campaign/maxis-unlimited-postpaid-and-fibre-for-maxis-home-fibre-customers) and the Service(s) (at https://www.maxis.com.my/terms-conditions/personal/), including changes to the Agreement. Your continued use of the Service(s) under the Campaign (after the Effective Date of any revision/change to the terms and conditions of Agreement and/or Service(s) relevant to the Campaign) shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same. If you do not accept such revisions/changes, you are entitled to terminate the Service(s) under this Campaign and/or the use of the Service(s) under this Campaign by giving us notice within 28 days from the Effective Date failing which you are assumed to have accepted the changes.
    1. To be eligible to participate in the Campaign and enjoy the Rewards continuously (as described in Clause 5 above), you must:
      1. be an existing Maxis Home Fibre customer subscribed to Maxis Home Fibre 100Mbps, 300Mbps, 500Mbps or 1Gbps; and
      2. be of at least 18 years’ old.
    2. You are ineligible to participate in the Campaign if:
      1. you are an existing subscriber of any Maxis Postpaid plan(s);
      2. you have any outstanding payments with us; and/or
      3. you are a commercial user and/or bulk subscriber.
    3. Notwithstanding the above, your eligibility for to participate in the Campaign and entitlement to the Rewards are subject to our absolute discretion.
    1. You are required to sign up for the Participating Maxis Plan in order to be eligible to the Rewards.
    1. Subject to your fulfilment of the conditions in Clause 5 and Clause 14 above, you are entitled to the Rewards.
    2. You will be able to check and verify your monthly Bill rebate in your Maxis Bill which can be downloaded from the Maxis app.
    1. The applicable Charges and rate table guide for the plans and Services are as set out on the respective SSTCs in Clause 5 above. Charges published on our website or stated in the respective SSTCs are exclusive of applicable taxes.
    2. You are responsible for the payment of all Charges associated with the Participating Maxis Plan and the Rewards under this Campaign.
    1. During the period of which you enjoy the Rewards, you shall NOT:
      1. terminate or suspend the Participating Maxis Plan or Maxis Postpaid Share 48 which you have subscribed to under this Campaign;
      2. cause your Maxis Postpaid account terminated for non-payment of monthly Bill(s); and/or
      3. change or transfer ownership of the Maxis Postpaid account to another person.
    2. If any of the events in Clause 19 above occurs, you will no longer be entitled to the Rewards as described in Clause 5 above. In this regard:
      1. you will be downgraded to Maxis Postpaid 69 from Maxis Unlimited Postpaid and Fibre; and
      2. any remaining monthly Bill rebate(s) will be forfeited with immediate effect.
    1. We reserve the rights at any time, without being liable to you or any third party, to interrupt, bar, suspend, restrict the Service(s) under the Campaign for such time as we see fit or terminate, discontinue or disconnect any of such Service(s) if your usage:
      1. shows excessive usage or placing unusual burden on our Network;
      2. is for unlawful activities or for suspected fraudulent activities; or
      3. is not in accordance with the FUP; and/or
      4. is for commercial/non-personal purposes.
    1. The Rewards is not redeemable and not refundable/exchangeable for cash.
    2. Maxis reserves the right to forfeit the Rewards if our attempt to fulfil the Rewards to you fails for any reason whatsoever.
    3. Maxis’ decision on who are eligible and entitled to the Rewards shall be final and conclusive and Maxis shall entertain no correspondence, complaint, or appeal at any time during or after the Campaign Period.
    4. Maxis shall not be liable to you or any other party for any loss or damage of whatsoever nature suffered by a participant or such other party as a result of participation or non-participation in the Campaign or as a result of any act or omission on Maxis’ part.
    5. The terms and conditions stated herein shall be governed by the Laws of Malaysia and subject to the exclusive jurisdiction of the courts of Malaysia.
