Service Specific Terms & Conditions (“SSTC”) - MAXIS ZEROLUTION CONTRACT for Devices

Version [21st November 2024]

    1. The Plan: Maxis Zerolution.
    2. The Plan shall be eligible to the following participating Maxis plan(s):
      1. any Maxis Postpaid 79, 109, 139, 169 or 199;
      2. Maxis Postpaid Share 48; or
      3. any Maxis Postpaid 98, 128, 158 or 188 (Pre-15th August 2023) (available before 15th August 2023 only);
      4. any Maxis Postpaid 69 or 99 (available in East Coast and East Malaysia only);
      5. Tablet: Maxis Postpaid Tablet Connect 18;
      6. Watch: Maxis Postpaid Watch Connect 18;
      7. any Maxis Family Plan 299, 399 or 499 (including Maxis Family Plan Member); and
      8. Maxis Family Plan Additional Member 48, (collectively referred to as “Participating Plans”).
      The Participating Plans may be subject to change from time to time.
    3. The Plan is not valid with any other offers and/or incentives, which have or may have been offered by Maxis or Hotlink under any other offers from time to time.
    4. You: Person(s) signing up for the Maxis Zerolution Plan.
    5. The use of the Service(s) is subject to the postpaid General Terms & Conditions ("GTC") at https://www.maxis.com.my/en/terms-conditions/personal/general/maxis-consumer/, this Service Specific Terms & Conditions – Maxis ZEROLUTION CONTRACT for Devices ("SSTC"), Maxis Fair Usage Policy at https://www.maxis.com.my/en/terms-conditions/general/maxis-fair-usage-policy/ and any other applicable terms and conditions at  https://www.maxis.com.my/en/terms-conditions/.
    6. Please note that the Participating Plans are further subject to the following:

    7. Capitalised terms herein have the same meaning as defined in the GTC.
    8. In the event of any conflict or inconsistency between this SSTC and the GTC, the SSTC shall prevail over the GTC over such conflict or inconsistency.
    9. We reserve the rights without liability, to revise this SSTC, the GTC, the Plan, the Participating Postpaid Plans and our pricing. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information on the Plan and Service(s) at https://www.maxis.com.my/en/terms-conditions/, including changes to the GTC and other applicable terms and conditions. Your continued use of the Service(s) and/or Plan (after the Effective Date of any revision/change to the terms and conditions of Services and/or Plan) shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same. If you do not accept such revisions/changes, you will terminate the Plan and/or the use of the Services by giving us notice within fifteen (15) Working Days from the Effective Date failing which you are assumed to have accepted the changes.
    1. A principal line must be registered in your name and be an active account under an eligible Participating Plans offered by us.
    2. You are ineligible for this Plan if you (a) have any outstanding payments with us; or (b) are a commercial user and/or bulk subscriber.
    1. You are responsible for payment of all Charges associated with the Plan.
    2. Depending on your credit check result and applicable Minimum Commitment Period (as defined below), we may collect from you Mobile Device advance payment (“Advance Payment”). If we collect Advance Payment from you, such advance amount will be refunded to you by way of rebate directly to your monthly bill or such other manner as Maxis deems fit over a period of 24-months or 36-months, as the case maybe.
    1. By accepting this Plan, you will enjoy one (1) Mobile Device at the price as offered by us on our website and/or sales material, which is exclusive of all applicable taxes ("Maxis Zerolution Fee"). For clarity, subject to your eligibility and credit check result, you may purchase and sign up more than one Mobile Device under the Plan on each Maxis Postpaid principal line.
    2. The minimum commitment period of this Plan shall be: -
      1. a period of twenty-three (23) months; or
      2. a period of thirty-five (35) months,
        from the date of registration of the Plan ("Minimum Commitment Period"). Where you are currently on different Mobile Device plan and you are entitled under that plan to upgrade or switch to this Plan, where applicable, your previous Mobile Device offer contract is deemed terminated as at the date of execution of this Plan subject to you first paying any early termination charges payable under the said previous contract.
    3. You shall not, during the Minimum Commitment Period, also during the Extended Period (hereinafter defined):
      1. terminate your Maxis Zerolution Plan;
      2. terminate your Maxis Postpaid account or port out to another mobile service provider;
      3. have your Maxis Postpaid account terminated for non-payment of monthly bills;
      4. downgrade your Participating Plan to the rate plan below your entry rate plan to Maxis Zerolution Plan. If you do downgrade to a lower rate plan, you will incur a Mobile Device remaining balance charge as stipulated in this SSTC;
      5. change your Participating Postpaid Plan to a rate plan that is not eligible for this Plan. The Participating Postpaid Plans eligible for this Plan are stated in Clause 2 above; or
      6. change or transfer ownership of this Plan to another person.
    4. You acknowledge and agree that if any of the events in Clause 16 above occurs, you shall pay us the early termination charges as stipulated in Clause 18 below (“Early Termination Charge”). Payment of the Early Termination Charge is without prejudice to the collection of all monies owing to us by you in accordance with your account up to the time of early termination. You will receive a final statement of account which will be due and payable by you to us immediately upon receipt. All outstanding amounts due and owing to us shall be subject to all applicable taxes.
    5. You agree we have the right to impose on you the Early Termination Charge, which you shall be responsible to pay if this Plan is terminated for whatsoever reason before the expiry of the Minimum Commitment Period. The Early Termination Charge is calculated as follows:
      1. For 23-months Minimum Commitment Period: [(Recommended Retail Price (RRP) ÷ 24 months) x remaining month(s) of the Minimum Commitment Period].
      2. For 35-months Minimum Commitment Period: [(Recommended Retail Price (RRP) ÷ 36 months) x remaining month(s) of the Minimum Commitment Period].
    6. In addition to Clause 18, in the event of early termination of this Plan before the expiry of the Minimum Commitment Period, you shall be further liable to pay us a Mobile Device non-return fee to be determined by us based on the Mobile Device model and its residual value or as stated in the Registration Form.  You are not required to return the Mobile Device upon payment of the Mobile Device non-return fee by you to us.
    7. If any of the account(s) / Service(s) under the Plan is suspended during the Minimum Commitment Period due to any reason whatsoever, the Maxis Zerolution Fee will continue to be charged to you.
    8. You agree we have the rights to block the IMEI of the Mobile Device if:
      1. you are suspected of fraud or found to have committed fraud;
      2. after signing up to this Plan, you fail to make full payment of any amount due within fourteen (14) days of the statement due date; or
      3. you have reported to us that the Mobile Device is missing or has been stolen and have requested us to block the IMEI of the Mobile Device.
    9. You are responsible for any loss, theft or damage to the Mobile Device at all times and shall continue to pay the Maxis Zerolution Fee for the Minimum Commitment Period and Extended Period, if applicable, notwithstanding that the Mobile Device is lost or damaged.
    10. You accept and acknowledge you have the obligation to observe and fulfill the terms and conditions of this Plan, including the Minimum Commitment Period, Mobile Device, payment and charges for the Plan and Accessory (if any), any early termination charge and Mobile Device non-return fee under the Plan, these terms and conditions and the General Terms and Conditions.
    11. You accept and acknowledge that the Mobile Device title and ownership does not belong to you during the Minimum Commitment Period. The Mobile Device is provided under this Plan to you and you are accountable for the use and safety of the Mobile Device. Nothing in this SSTC shall be construed as transferring the title or ownership of the Mobile Device to you unless otherwise expressly stated. You shall not directly or indirectly give or allow another person to give any interest in or lien over the Mobile Device. You shall promptly, at your own costs and expenses, take all such actions as may be necessary to duly discharge or eliminate any such liens over the Mobile Device upon obtaining actual knowledge thereof.
    1. The Mobile Device is to be returned to us in good working order upon the expiry of the Minimum Commitment Period.
    2. In the event that the Mobile Device is not returned to us upon the expiry of the Minimum Commitment Period, this Plan shall continue to be valid and effective for another one (1) month (“Extended Period”) wherein the Maxis Zerolution Fee shall continue to be payable to us. This Plan shall be terminated on the expiry of the Extended Period.
    3. Within the Extended Period:
      1. if you wish to terminate the Plan and you return the Mobile Device to us in good working order, this Plan shall be terminated and you shall not be liable to any Mobile Device non-return fee.
      2. if you wish to terminate the Plan or when the Plan is terminated but you failed to return the Mobile Device to us on the termination of the Plan, a Mobile Device non-return fee (as stated in the Registration Form) will be charged as compensation. You are not required to return the Mobile Device upon payment of the Mobile Device non-return fee by you to us.
    4. For the avoidance of doubt, notwithstanding anything to the contrary, we are not obliged to accept the Mobile Device should you seek to return the Mobile Device after the Extended Period.
    5. In any event if the Mobile Device is returned to us but the same is not in good working condition,
      1. we shall be entitled to charge you for any cost of repair to make good the Mobile Device and you shall pay the same unless the cost of repair is partially or fully covered under the Maxis Safe Device (MSD) plan subscribed by you. Any portion of the cost not covered under the Maxis Safe Device (MSD) plan shall be borne by you; and/or
      2. notwithstanding sub-paragraph (a), we may, at our sole discretion, decide not to accept the return of the Mobile Device irrespective of whether you have a Maxis Safe Device (MSD) plan and irrespective of whether you wish to pay for the cost of repair, where we determine that the condition of the Mobile Device is not acceptable to us. In such instance, you will be charged the Mobile Device non-return fee as stated in the Registration Form. Upon payment of the Mobile Device non-return fee by you to us, the Mobile Device shall be regarded as belonging to you.
    6. The payment of the Mobile Device non-return fee (if any) by you is without prejudice to any other charges and fees due to us including charges under the Participating Plan and early termination charges. It shall be your obligation to return the Mobile Device in accordance with the terms and conditions stated herein.
    1. If you have subscribed to any Maxis Postpaid plan, you have the option to purchase accessories such as handphone cases, screen protectors, power bank, charging adaptors, USB cable, add-on speakers, headphones, stands, selfie sticks, car kits, replacement batteries, smart watch and other products or items related to the Mobile Device (“Accessory”) at the price as offered by us, which is exclusive of all applicable taxes.
    2. Accessory may be subject to a contract term commences from the date of purchase and continues for one (1) year (“Term of Accessory”).
    3. If Term of Accessory is applicable, you will be billed for the Accessory purchase price in equal monthly installments under Maxis Zerolution Plan.
    4. You agree we have the right to impose the Accessory remaining balance charge, which you shall be responsible to pay if you decide to terminate before the expiry of the Term of Accessory. The Accessory remaining balance charge is calculated as follows: [(Recommended Retail Price (RRP) ÷ 12 months] x remaining month(s)].
    5. Accessory is not applicable to Hotlink Postpaid plan subscriber.
    1. We will not be responsible for replacing the Mobile Device or any part thereof that is lost, stolen, damaged or defective (regardless such defect is a manufacturer defect or due to the reason of installation of unauthorized app). You shall be responsible for the repair and maintenance of the Mobile Device. Repairs shall be subject to the applicable warranty issued by the manufacturer.
    1. In the event your Port request to us is still pending from the DNO, and you wish to subscribe to the Plan before successful Porting of your Mobile Number to Maxis, you confirm, agree and understand that:
      1. a Mobile Number provided by us will be attached to the Mobile Device purchased under this Plan (“Interim Mobile Number”) with a SIM Card or eSIM (Maxis’ SIM Card or Maxis’ eSIM), as the case maybe;
      2. the Plan shall be effective and commence on the date of registration for the Plan and not on the date of which your Port request is successful; and
      3. you shall make and continue to make payment for the Charges associated to the Plan (including the Charges for the Mobile Device purchased) from the date of registration of the Plan regardless of whether your Port request to Maxis is successful.
    2. In the event your Port request is successful within thirty (30) days from the date of registration of the Plan, you confirm and agree that:
      1. we will swap or switch the Interim Mobile Number to your Mobile Number provided by the Donor (“Your Mobile Number”) at our end. In this case, Service to the Interim Mobile Number will be deactivated. You must make request to us separately if you wish to retain the Interim Mobile Number which such request is subject to registration on any Maxis’ mobile plan and strictly subject to availability; and
      2. we will notify you of the successful Port-in and Service of Your Mobile Number will be available on the Maxis’ SIM Card or Maxis’ eSIM and you may discard your previous SIM provided by the DNO.
    3. In the event your Port request is not successful after thirty (30) days from the date of registration of the Plan or where your Port request failed, is rejected by the DNO or unsuccessful, for whatsoever reasons, you confirm and agree that:
      1. we shall not be liable or responsible to you or any third party for any loss or damage whether direct, indirect, special or consequential, or for loss of business, revenue or profits or of any nature suffered by you, or any other person, or any injury caused to or suffered by a person or damage to property;
      2. the Interim Mobile Number shall automatically become your new Maxis Mobile Number line without notice from us;
      3. you shall remain responsible and liable for the Charges (including the Charges for the Mobile Device purchased) associated with the Plan; and
      4. if you decide to terminate the Plan before the expiration of the Minimum Period of Service, you shall pay us the early termination charges as set out in clause 18 above and where applicable, the Mobile Device non-return fee as described in clause 19 above.
    4. For the avoidance of doubt, should this section applies to you, clause 12 of the GTC (save for clause 12.8) shall be applicable to you.
    1. Maxis Network Exclusive Device refers to certain Mobile Devices which will be locked and can be used with Maxis SIM Card only within the Plan’s Minimum Commitment Period, to protect you from fraud and reduce theft. From 15 January 2024, any iPhone 13/ 14 (128GB) or such other Mobile Devices model (as may be notified by Maxis from time to time) purchased from us or from third party authorised by us under the Plan and activated on Maxis SIM Card is locked to Maxis automatically, and the following terms will apply:
      1. Upon the activation of the Plan, the Mobile Device will be locked to Maxis’ network for a period of twelve (12) months (“Lock Period”). During the Lock Period, you will not be able to connect your Mobile Device to another operators’ or carrier’s network (locally as well as overseas);
      2. After the end of the Lock Period, we will automatically remove the lock in which you will be able to use other operator’s SIM Card (locally as well as overseas) on your Mobile Device, unless the Mobile Device is deemed stolen or we suspect fraudulent purchase of the Mobile Device; and
      3. If you intend to use other operator’s SIM Card on your Mobile Device at any point of time within the Lock Period, you may do so by terminating the contract under this Plan and in such a case, the early termination charges (Clause 18) and mobile device non-return fee (Clause 19), as the case may be, shall apply.
    2. For clarity, you may use the Mobile Devices that are locked to Maxis Sim Card for roaming on overseas network when travelling abroad by subscribing to Maxis roaming passes.
    1. Subject to approval by Maxis based on your application and credit check result, a minimum 3-months waiting period is applicable to you for this Plan if you are:
      1. a new customer of Maxis/ Hotlink; or
      2. an existing customer of Maxis/ Hotlink eligible to take up more than one (1) Mobile Device contract under the same Malaysian identity card number or passport number, where each Mobile Device contract must be three (3) months apart.
    1. The Plan cannot be exchanged for cash.
