Service Specific Terms & Conditions (“SSTC”) – TV for Maxis Postpaid Customers

- The Plan: TV for Maxis Postpaid Customers
- The Plan shall be eligible to the following participating Maxis plan(s) (collectively referred to as “Participating Plans”):
- any Maxis Postpaid 79, 109, 139, 169 or 199;
- any Maxis Postpaid 69 or 99 (available in Kelantan and East Malaysia only);
- any Maxis Unlimited Postpaid and Fibre (with Maxis Postpaid 69,79,99,109,139,169 or 199); and
- any Maxis Unlimited Postpaid and Home WiFi (with Maxis Postpaid 69,79,99,109,139,169 or 199).
The Participating Plans may be subject to change from time to time.
- The Plan is not valid with any other offers and/or incentives, which have or may have been offered by Maxis or Hotlink under any other offers from time to time.
- You: Person(s) signing up for the Plan.
- The use of the Service(s) is subject to the postpaid General Terms & Conditions ("GTC") at https://www.maxis.com.my/en/terms-conditions/personal/general/maxis-consumer/, this Service Specific Terms & Conditions – TV for Maxis Postpaid Customers ("SSTC"), Maxis Fair Usage Policy at https://www.maxis.com.my/en/terms-conditions/general/maxis-fair-usage-policy/ and any other applicable terms and conditions at https://www.maxis.com.my/en/terms-conditions/.
- Please note that the Participating Plans are further subject to the following:
- or Maxis Postpaid 79, 109, 139, 169 or 199: SSTC - Maxis Postpaid (https://www.maxis.com.my/en/terms-conditions/products-services/mobile/postpaid-plan); or
b. for Maxis Postpaid 69 or 99: SSTC – Maxis Postpaid 69 & 99 (https://www.maxis.com.my/en/terms-conditions/products-services/mobile/postpaid-69-and-99/); or
c. for Maxis Unlimited Postpaid and Fibre: SSTC – Maxis Unlimited Postpaid and Fibre (https://www.maxis.com.my/en/terms-conditions/products-services/mobile/maxis-unlimited-postpaid-fibre-plan/); or - for Maxis Unlimited Postpaid and Home WiFi: SSTC – Maxis Ulimited Postpaid and Home WiFi (https://www.maxis.com.my/en/terms-conditions/products-services/mobile/maxis-unlimited-postpaid-and-home-wifi/).
- or Maxis Postpaid 79, 109, 139, 169 or 199: SSTC - Maxis Postpaid (https://www.maxis.com.my/en/terms-conditions/products-services/mobile/postpaid-plan); or
- Capitalised terms herein have the same meaning as defined in the GTC.
- In the event of any conflict or inconsistency between this SSTC and the GTC, this SSTC shall prevail over the GTC over such conflict or inconsistency.
- We reserve the rights without liability, to revise this SSTC, the GTC, the Plan, the Participating Plans and our pricing. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information on the Plan and Service(s) at https://www.maxis.com.my/en/terms-conditions/, including changes to the GTC and other applicable terms and conditions. Your continued use of the Service(s) and/or Plan (after the Effective Date of any revision/change to the terms and conditions of Services and/or Plan) shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same. If you do not accept such revisions/changes, you will terminate the Plan and/or the use of the Services by giving us notice within fifteen (15) Working Days from the Effective Date failing which you are assumed to have accepted the changes.

- A principal line must be (a) registered in your name; and (c) an active account under any of the Participating Plans. Each account is only eligible to sign up for one (1) Home Device under the Plan, regardless of number of participating plans under the account.
- You are ineligible for the Plan if you (a) have any outstanding payments with us; or (b) are a commercial user and/or bulk subscriber.

- You are responsible for payment of all Charges associated with the Plan.
- Depending on your credit check result and applicable Minimum Commitment Period (as defined below), we may collect from you a Home Device advance payment (“Advance Payment”). If we collect the Advance Payment from you, such advance amount will be refunded to you by way of rebate directly to your monthly bill or such other manner as Maxis deems fit over a period of 36-months.

- By accepting the Plan, you will enjoy one (1) Home Device at the price as offered by us on ou sales material, which is exclusive of all applicable taxes ("Maxis Zerolution Fee").
- The minimum commitment period of the Plan shall be a period of thirty-five (35) months, from the date of registration of the Plan ("Minimum Commitment Period").
- You shall not, during the Minimum Commitment Period, also during the Extended Period (hereinafter defined):
- terminate the Plan;
- terminate your Maxis Postpaid account or port out to another mobile service provider;
- have your Maxis Postpaid account terminated for non-payment of monthly bills;
- change your Maxis Postpaid Plan to a rate plan that is not eligible for the Plan; or
- change or transfer ownership of the Plan to another person.
- You acknowledge and agree that if any of the events in Clause 16 above occurs, you shall pay us the early termination charges as stipulated in Clause 18 below (“Early Termination Charge”). Payment of the Early Termination Charge is without prejudice to the collection of all monies owing to us by you in accordance with your account up to the time of early termination. You will receive a final statement of account which will be due and payable by you to us immediately upon receipt. All outstanding amounts due and owing to us shall be subject to all applicable taxes.
- You agree we have the right to impose on you the Early Termination Charge, which you shall be responsible to pay if the Plan is terminated for whatsoever reason before the expiry of the Minimum Commitment Period. The Early Termination Charge is calculated as follows:
[(Recommended Retail Price (RRP) ÷ 36 months) x remaining month(s) of the Minimum Commitment Period].
- In addition to Clause 18, in the event of early termination of the Plan before the expiry of the Minimum Commitment Period, you shall be further liable to pay us a Home Device non-return fee to be determined by us based on the Home Device model and its residual value or as stated in the Registration Form (“Non-Return Charge”). You are not required to return the Home Device upon payment of the Home Device non-return fee by you to us.
- If any of the account(s) / Service(s) under the Plan is suspended during the Minimum Commitment Period due to any reason whatsoever, the Maxis Zerolution Fee will continue to be charged to you.
- You are responsible for any loss, theft or damage to the Home Device at all times and shall continue to pay the Maxis Zerolution Fee for the Minimum Commitment Period and Extended Period, if applicable, notwithstanding that the Home Device is lost or damaged.
- You accept and acknowledge you have the obligation to observe and fulfill the terms and conditions of the Plan, including the Minimum Commitment Period, Home Device, payment and charges for the Plan and Accessory (if any), any early termination charge and Home Device non-return fee under the Plan, these terms and conditions and the General Terms and Conditions.
- You accept and acknowledge that the Home Device title and ownership does not belong to you during the Minimum Commitment Period. The Home Device is provided under the Plan to you and you are accountable for the use and safety of the Home Device. Nothing in this SSTC shall be construed as transferring the title or ownership of the Home Device to you unless otherwise expressly stated. You shall not directly or indirectly give or allow another person to give any interest in or lien over the Home Device. You shall promptly, at your own costs and expenses, take all such actions as may be necessary to duly discharge or eliminate any such liens over the Home Device upon obtaining actual knowledge thereof.

- The Home Device is to be returned to us in good working order upon the expiry of the Commitment Period.
- In the event that the Home Device is not returned to us upon the expiry of Commitment Period, the Plan(s) shall continue to be valid and effective for another one (1) month (“Extended Period”) wherein the Home Zerolution Fee shall continue to be payable to us. The Plan shall be terminated on the expiry of the Extended Period.
- Within the Extended Period:
- if you wish to terminate the Plan and you return the Home Device to us in good working order, the Plan(s) shall be terminated and you shall not be liable to any Non-Return Charge.
- if you wish to terminate the Plan or when the Plan is terminated but you failed to return the Home Device to us upon termination of the Plan, a Non-Return Charge will be charged as compensation.
- For the avoidance of doubt, notwithstanding anything to the contrary, we are not obliged to accept the Home Device should you seek to return the Home Device after the Extended Period.

- The Home Device will be delivered to your doorstep for free, unless otherwise stated by us to you. You acknowledge that the Home Device may not be available for immediate delivery. You will receive a call from our delivery partner within 3 business days from the commencement of your Commitment Period under the Plan for delivery appointment. Delivery slots are subject to availability. You will need to present your original NRIC used during sign-up to our delivery partner or passed the identity verification check conducted by our delivery party upon delivery.
- Maxis cannot and will not accept responsibility for delivery failures or delays by our third party delivery partner or reschedule of delivery appointment by you.

- If you have subscribed to any Maxis Postpaid plan, you have the option to purchase accessories such as handphone cases, screen protectors, power bank, charging adaptors, USB cable, add-on speakers, headphones, stands, selfie sticks, car kits, replacement batteries, smart watch and other products or items related to the Home Device (“Accessory”) at the price as offered by us, which is exclusive of all applicable taxes.
- Accessory may be subject to a contract term commences from the date of purchase and continues for one (1) year (“Term of Accessory”).
- If Term of Accessory is applicable, you will be billed for the Accessory purchase price in equal monthly installments under Maxis Zerolution Plan.
- You agree we have the right to impose the Accessory remaining balance charge, which you shall be responsible to pay if you decide to terminate before the expiry of the Term of Accessory. The Accessory remaining balance charge is calculated as follows: [(Recommended Retail Price (RRP) ÷ 12 months] x remaining month(s)].
- Accessory is not applicable to Hotlink Postpaid plan subscriber.

- Maxis shall not be responsible for any warranty claim for the Home Device. Please contact the manufacturer of the Home Device or their authorised repairer (MTT Solutions Sdn. Bhd. Customer Service Hotline: 012-969 6305) directly if the manufacturer’s warranty period for the Home Device has not expired, for assistance.
- Further we will not be responsible to replace the Home Device or any part thereof that is lost, stolen, damaged or defective (regardless such defect is a manufacturer defect or due to the reason of installation of the Home Device). You shall be responsible for the repair and maintenance of your Home Device at all times except where the repairs are still subject to the applicable warranty issued by the manufacturer.

- In the event your Port request to us is still pending from the DNO, and you wish to subscribe to the Plan before successful Porting of your Mobile Number to Maxis, you confirm, agree and understand that:
- a Mobile Number provided by us will be attached to the Home Device purchased under this Plan (“Interim Mobile Number”) with a SIM Card or eSIM (Maxis’ SIM Card or Maxis’ eSIM), as the case maybe;
- the Plan shall be effective and commence on the date of registration for the Plan and not on the date of which your Port request is successful; and
- you shall make and continue to make payment for the Charges associated to the Plan (including the Charges for the Home Device) from the date of registration of the Plan regardless of whether your Port request to Maxis is successful.
- In the event your Port request is successful within thirty (30) days from the date of registration of the Plan, you confirm and agree that:
- we will swap or switch the Interim Mobile Number to your Mobile Number provided by the Donor (“Your Mobile Number”) at our end. In this case, Service to the Interim Mobile Number will be deactivated. You must make request to us separately if you wish to retain the Interim Mobile Number which such request is subject to registration on any Maxis’ mobile plan and strictly subject to availability; and
- we will notify you of the successful Port-in and Service of Your Mobile Number will be available on the Maxis’ SIM Card or Maxis’ eSIM and you may discard your previous SIM provided by the DNO.
- In the event your Port request is not successful after thirty (30) days from the date of registration of the Plan or where your Port request failed, is rejected by the DNO or unsuccessful, for whatsoever reasons, you confirm and agree that:
- we shall not be liable or responsible to you or any third party for any loss or damage whether direct, indirect, special or consequential, or for loss of business, revenue or profits or of any nature suffered by you, or any other person, or any injury caused to or suffered by a person or damage to property;
- the Interim Mobile Number shall automatically become your new Maxis Mobile Number line without notice from us;
- you shall remain responsible and liable for the Charges (including the Charges for the Home Device purchased) associated with the Plan; and
- if you decide to terminate the Plan before the expiration of the Minimum Period of Service, you shall pay us the early termination charges as set out in Clause 18 above and where applicable, the Non-Return Charge as described in Clause 19 above.
- For the avoidance of doubt, should this section applies to you, Clause 12 of the GTC (save for Clause 12.8) shall be applicable to you.
- In the event your Port request to us is still pending from the DNO, and you wish to subscribe to the Plan before successful Porting of your Mobile Number to Maxis, you confirm, agree and understand that:

- Subject to approval by Maxis based on your application and credit check result, a minimum 3-months waiting period is applicable to you for the Plan if you are a new customer of Maxis.
- Subject to approval by Maxis based on your application and credit check result, a minimum 3-months waiting period is applicable to you for the Plan if you are a new customer of Maxis.

- The Plan cannot be exchanged for cash.
